-30- <br />These questions were incorporated into the Division's initial adequacy <br />letter. <br />Question regarding generation of refuse material and its storage on the <br />surface. <br />NCEC is required to construct the pile to be a permanent feature. <br />Question regarding feasibility of in-mine disposal of coal processing <br />waste. <br />The Division is specifically not approving NCEC's plan. NCEC may <br />resubmit the proposal after it has approval from the Mine Safety and <br />Health Administration (MSHS). , <br />Why is mine access road being left following reclamation? <br />This is consistent with the post-mining land use and is permitted by Rule <br />4.03.1(7). <br />Reclamation cost estimates were alleged to be too low. <br />The Division conducted an engineering cost estimate of the proposed <br />reclamation and based the reclamation bond on that estimate. This is <br />discussed in Section XXI of the findings. <br />uestion about Air Pollution Control Plan. <br />The necessary permits have been obtained from the Colorado Department of <br />Health, Air Quality Division. <br />NCEC has no permitted loadout. <br />The Division finds that a mine can be permitted without a loadout. The <br />decision is to approve, in part, the application without approving the <br />proposed loadout. See Section XV of this document for additional <br />discussion regarding the proposed loadout near Lacy, Colorado. <br />Letter from Riverbend Subdivision Homeowners to the Division, dated May 1, <br />1990. This letter was signed by 18 residents. <br />Lgadout possibilities are not appropriate. <br />The loadout location has been changed during the review period, and is <br />specifically not being approved at this time. <br />
