Rules 2.05.6(6) and 4.20 - Subsidence <br />Based on the information presented in the application, it was found that <br />no renewable resource lands will be affected by the proposed mining operation. <br />The land overlying the OC q2 workings is all used for grazing and wildlife <br />habitat. The surface is mainly sagebrush and grass with scattered stands <br />of aspen. There are no aquifers which could be affected by this operation. <br />The proposed operation is in compliance with the requirements of this section. <br />X_X2V, Rules 2.06, 4.22, 4.23, 9.2G, 9.27, 9.28 and 9.29 - Special Categories <br />Of Mining (Other Than AVF and Prime Farmlands) <br />There are no special categories of mining that apply to this operation. <br />XXV. Rules 2.05.6(5), 4.02, 9.12, 9.19, 4.21, 9.28 and~9.30 - Miscellaneous. <br />Compliance <br />No problems were identified with respect to the requirements of these sections <br />such as signs and markers, surface coal mining next to underground workings, <br />slides, facilities not at or near the mine site, etc. The proposed operation is <br />in compliance with the requirements of this section. <br />XXVI. Rules 2.03.7 and 2.10 - Operations On Land Subject To Limitations Or <br />Prohibitions <br />The Division finds pursuant to the finding required by 2.07.6(2)(d), that <br />the permit area of the proposed operation is not within: <br />a. an area designated unsuitable for surface coal mining operations, <br />b. an area under study for designation as unsuitable for suzface coal <br />mining operations, <br />c. any lands subject to prohibitions or limitation under Rule 2.07.6 <br />(2) (d) (iii), and <br />d. 300 feet, measured horizontally, of any occupied dwelling. <br />Additionally, the Division finds that the proposed operation will not ad- <br />versely affect any publicly owned park or place listed on the National Regis- <br />ter of Historic Places. <br />XXVII. Rule 2.07.6(2)(b) - Demonstration That Surface Coal Mininy and Recla- <br />mation Opera tians Can Be Feasibly Accomplished <br />Pursuant to Rule 2.07.6(2)(b) the Division finds, based on information in <br />the application and from all available sources, that surface coal mining <br />and reclamation operations can be feasibly accomplished under the mining <br />and reclamation plan contained in the permit application. <br />XXVIII. Compatibility With Anticipated Adjacent Operations <br />The Ohio Creek Coal Mine No. 2 is the only mine in the vicinity of Gunnison, <br />
