_lg_ <br />The applicant has supplied adequate baseline climatolonical information. The <br />applicant has filed applications for emissions permits with the Air Pollution <br />Control Division - Colorado Department of Health for the mine and tipple facilities. <br />Copies of these applications have been orovided and the permittee will provide <br />final permit copies to the Division as the Department of Health approves the permits. <br />The Division finds the operation to be i'n compliance with the requirements of this <br />section. <br />XI, Topsoil - Rules 2.04.9, 2,05.3(5), 2,05.4(2)(d) and 4.16 <br />The Division has reviewed the permit application for the information on soil <br />resources, topsoil removal, handling and respreading, and pertinent performance <br />standards contained in Sections 9,7 (pages IV-SO - IV-51), Exhibit IV-Z0, and <br />pages 34-42 of the June I8, 1992 response. <br />Soils within the permit area range from deep sandy Zoams in the Del Agua Canyon to <br />rocky outcrops along ridges. A11 soil types to be disturbed are suitable for <br />reclamation, and of sufficient quantity to provide an average redistribution depth <br />of Z9 inches. <br />In describing topsoil replacement and handling, the applicant states that topsoil <br />will be redistributed on backfilled and graded areas from areas where stripping <br />is taking place, with extra topsoil being placed in topsoil stockpiles. Table <br />V-3 (revised) indicates all topsoil to be replaced will be from topsoil stockpiles. <br />This is inconsistent with operations on the ground. It is therefore stipulated: <br />Stipulation No. 5: <br />THE PERMITTEE WILL REVISE TRB LE V-3 TO REFLECT TOPSOIL HANDLING <br />AND STORAGE OPERATIONS AS THEY OCCUR ON THE GROUND. THE TABLE <br />SHALL PROJECT TOPSOIL VOLUMES FROM ERCH CUT FOR EACH PIT, AND WILL <br />INDICATE THE DISPOSITION OF EXCESS TOPSOIL TO SPECIFIC TOPSOIL <br />STOCKPILES. IF THERE IS R DEFICIT, THE TABLE SHALL IDENTIFY WHICH <br />STOCKPILE TOPSOIL 14ATERIAL WILL COP1E FROM AND VOLUh1E TO BE REMOVED. <br />THIS TABLE WILL BE SUBMITTED TO A1JD APPROVED BY THE DIVISION GJITHIN <br />60 DAYS AFTER PERMIT ISSUANCE. <br />The applicant has proposed to seed and mulch topsoil stockpiles which remain inactive <br />for more than 90 days. The applicant has not proposed a temporary stabilization <br />seed mix or mulching plan For these stockpiles. It is therefore stipulated that: <br />Stipulation No. 6: <br />4JITHIN 60 DAYS OF PERMIT ISSUANCE, 1'HE PERPI7TTEE S1fALL SUBMIT RND <br />HAVE APPROVED BY THE DIVISION R PLAN ADDRESSING THE MULCHING AND <br />SEEDING OF TOPSOIL STOCKPILES. TXE 1ULCHING PLAN SHALL INCLUDE, <br />AT A MINIMUM; TYPE OF MULCX, 14ETXOD OF APPLICATION, AND RATE OF <br />APPLICATION, THE SEED MIX SNRLL INCLUDE, AT A MINIMUFf; SPECIES <br />TO BE SEEDED, RATES OF SEEDIfJG FOR EACX SPECIES IN POUNDS P,L.S./ <br />ACRE, METHOD OF SEEDING, AND TIME OF SEEDING. <br />With the acceptance of these stipulations, the proposed operation is in compliance. <br />
