Recommendation I recommend termination of Federal permit CO-0020, issued on January 20, 1983, for the Powderhorn Coal Company Roadside and Cameo mine. My recommendation is based on the esiatence of the Colorado cooperative agreement which provides for the delegation to the Colorado Mined Land Reclamation Division (NERD) of the permitting responsibilities for operations on Federal lands pursuant to Section 523 of the Surface Mining Contra l and Reclamation Act (SMCRA); the issuance of the Colorado State permit C-81-041 in accordance with the Colorado State program and cooperative agreement; incorporation of all necessary Federal permit conditions in the State permit; and the approved mining plan for Federal leases, C-01538, C-078049, C-020740, C-024998, and C-029889. Attached to this memorandum are the applicable standard and special conditions of approval of the Roadside and Cameo mine mining plan approved by the Assistant Secretary an January 17, 1983, for Federal leases C-01538, C-078049, C-020740, C-024998, and C-029889. These conditions were previously incorporated in the Federal permit. Notxithstanding the termination of the Federal permit, these conditions will remain in full force and effect. Colorado MLRD has reviewed the permit application package (PAP) for the Roadside and Cameo mine under the Colorado State program and cooperative agreement (30 CFR 906.30) and has issued Colorado permit C-81-041 authorizing surface coal mining and reclamation operations on Federal and non-Federal lands in the permit area pursuant to the State program and cooperative agreement. A copy of the 'pond in the amount of $2,500,.000, payable to the United States and the State of Colorado, is on file with OSMRE.
