<br />ADDENDUM ATTACHED TO AND MADE A PART OF RECEIPT AND OPTION CONTRACT <br />DATID , 1980, BETWEEN KYOSUKE K. SAKAGUCHI, <br />KATHERINE K. SAKAGUCHI, ROBERT K. SAKAGUCHI AND LINDA SAKAGUCHI, <br />~ SELLEBS, AND ROSS T. PLOWMAN, JOHN J. HAINES, DALE R. GUMMEBSALL, <br />AND PHIL J. SPANO, PURCHASERS <br />WELL USAGE: <br />• 1. Purchasers shall have the right to the use of a 1200 gpm irrigation <br />well located on adjacent real estate owned by the Sellers for irrigation of the <br />above described premises to complement the ten shares of Fulton Irrigating Ditch <br />• stock; the well is presently being utilized by the Sellera in part to irrigate <br />the described premises. <br />2. Purchasers shall have the use of irrigation wares from said 1200 gpm <br />~ well in ea amount not to exceed 100 acre feet per year for evaporation augmen- <br />ration purposes resulting from a Band and gravel operation proposed for said <br />premises, subject to the following: <br />~ (a) Purchasers to pay a pro rata share of pumping expense and necessary <br />repairs. <br />(b) The above well is located in the Central Water Conservancy Dis- <br />~ trict and Purchasers shall pay a pro rata share of assessments imposed by said <br />district. <br />(c) In the event it shall be necessary to obtain a change of use <br />~ permit from the Water Court, Division I, State of Colorado, to accomplish such <br />proposed augmentation, such change in use permit cost shall be obtained and paid <br />for by the Purchasers. <br />~ SURVEY: <br />1. The Purchasers shall obtain a survey by a licensed surveyor, licensed <br />by the State of Colorado on a boundary line survey of said premises shoving all <br />~ existing or dedicated roads and acreage calculation. Such survey shall be ob- <br />rained and furnished to the Sellers thirty days prior to closing. <br />NOTE AND DEED OF TRUST: <br />~ 1. The Purchasers shall issue the first trust deed to secure the promissory <br />note.deacribed herein; the trust deed shall describe the real estate and eater <br />rights as described. The note may be prepaid in an amount not to exceed thirty- <br />~ five per cent of the principal of said note in any one calendar year without <br />penalty after January 1, 1983. <br />2. The Purchasers may transfer title to said security provided the makers <br />• <br /> <br />
