W I T N E S S E T H
~ That in consideration of mutual premises and other
covenants and agreements, the parties agree as follows:
1. Henderson owns a tract of land with the following
~ legal description:
That part of the NE 1/4 of the SE 1/4, Section 26 and
part of the NW 1/4 of the SW 1/4, Section 25, T1S, R67W,
6th P.M., Adams County, Colorado, lying west of US 85,
except roads, being more particulary described as follows:
~ Beginning at the SW corner, NE 1/4, SE 1/4, Section 26,
T1S, R67W; thence N89 27'43"E, a distance of 30.00 feet
to the true point of beginning; thence N00 02'31"E along
a line parrallel with the west line of the NE 1/4 of the
SE 1/4 of Section 26, a distance of 1286.60 feet; thence
N89 22'48"E along a line parallel with the north line of
• the NE 1/4 of the SE 1/4 of Section 26, a distance of
1281.08 feet; thence N89 32'01"E along a line parallel
with the north line of the SW 1/4 of Section 25, a dis-
tance of 397.71 feet to a point on the west right-of-
way line of US Highway 85; thence S23 24'53"W along the
west right-of-way line of US Highway 85, a distance of
~ 10.94 feet; thence S3 29'07"E continuing along the west
right-of-way line of US Highway 85, a distance of 99.50
feet; thence S23 24'53"W continuing along the west right-
of-way line of US Highway 85, a distance of 1289.50 feet
to a point on the south line of the NW 1/4 of the SE 1/4
of Section 26; thence S89 27'34"w along the south line
~ of the NE 1/4 of the SE 1/4 of Section 26, a distance of
1168.97 feet; to the true point of beginning, containing
42.75 acres, more or less,
and Henderson has the right to extract sand and gravel and other
~~ minerals from said tract.
2. The Company has the equipment, manpower and other
resources to competentaly extract the sand and gravel from
I~ said tract and is willing to do so upon the conditions here-
inafter set forth.
3. The Company, not the landowner, will obtain the
I~ necessary zoning for the extraction of sand and gravel and
obtain the necessary approvals from the State and County
authorities for the extraction.
