with the General Specifications and broadcasts the seed in <br />accordance with the General Specifications. Please note that the <br />seedbed must be loosened by equipment or by hand in either case and <br />that all broadcast seed must be covered about 1/4 to 1/2 inch deep <br />by flexible-tine harrowing or a similar method acceptable to the <br />Project Manager. The CONTRACTOR must get prior written <br />authorization before commencing with any broadcast seeding <br />activities. <br />I also have a number of concerns about your performance as <br />described and documented to me by the PROJECT MANAGER that must be <br />corrected. The concerns are as follows; <br />A. The CONTRACTOR disturbed approximately 2 acres of previously- <br />reclaimed land adjacent to Chen's Hill having approximately 6 <br />inches of topsoil and grass cover. Approximately 1,613 cubic yards <br />of topsoil was lost during this process and will need to be <br />replaced by either importing topsoil to the site from a permitted <br />source or using the material stockpiled on the north end of Chen's <br />Hill discussed above. The CONTRACTOR is also responsible for the <br />revegetation of this site at no cost to the OWNER. Revegetation <br />shall include all of the same requirements listed for the GEC/East <br />Pit Coal Reclamation Project (RN-MINES-322). <br />B. The CONTRACTOR wasted approximately 2,419 cubic yards of <br />overburden into the East Pit during the initial work on the <br />southeast corner of the East Pit. The extent of this loss amounted <br />to approximately 1 acre at 1 1/2 feet thick. Task 11 states in <br />part that "Prior to grading down the east side of the pit, the top <br />1 foot of topsoil will be stripped and stockpiled to the east, <br />north and south." "It is recognized that some topsoil will be lost <br />into the pit as the CONTRACTOR will have to stay away from the edge <br />of the highwall during these stripping operations. The CONTRACTOR, <br />in conjunction with the PROJECT MANAGER will determine what is to <br />be the safe distance." Also, Amendment 1 states in part that <br />"Following topsoil removal and segregation, next two feet of <br />available overburden will be stripped and stockpiled to the east <br />north and south for use as a growth medium. Stripping operations <br />will be required along the entire length of the East Pit above the <br />Highwall as this area is currently undisturbed." <br />The CONTRACTOR did not determine a safe distance to work in <br />conjunction with the PROJECT MANAGER at this location and as a <br />result lost excessive quantities of salvageable material. <br />Approximately 2,419 cubic yards of overburden was lost during this <br />process and will need to be replaced by either importing suitable <br />overburden, as approved by the PROJECT MANAGER, to the site from a <br />permitted source or using the material stockpiled on the north end <br />of Chen's Hill discussed above. <br />C. The CONTRACTOR did not compact the fill material in accordance <br />with the Invitation and Bid document. Task 11 states in part that <br />"All fill material obtained from cut areas and placed within fill <br />areas shall be placed in maximum 2-foot horizontal lifts and <br />
