Special Conditions, not the map. Amendments shall take precedence <br />in the area of the bid documents which they modify or clarify. <br />Amendment 1 to RN-Mines-322 states "The topsoil and overburden <br />growth medium which is located in the topsoil stockpile located <br />above the drainage on the east side of Chen's Hill and the two <br />stockpiles located on the north side of Chen's Hill must be evenly <br />replaced on the outslopes having a finished grade to a depth of 6 <br />inches." Even though all stockpiles located to the north of Chen's <br />Hill were discussed at the prebid and preconstruction meeting, the <br />two stockpiles containing approximately 2800 cubic yards were not <br />specifically included in either the Special Conditions, Map or the <br />amendment 1, therefore they do not have to be moved as part of the <br />required work. <br />2. Regarding the 5,000 cubic yards of previously stockpiled <br />topsoil located on the East Pit area. <br />Task 7, 9, and 13 state that "Topsoil/growth medium is <br />available from stockpiles located at the East Pit on Map 7." The <br />map shows only a single stockpile location. As outlined in the <br />General Conditions, page 1, In case of a difference between the <br />contract documents, precedence shall be given to the Special <br />Conditions, not the map. As more than one stockpile is mentioned, <br />the Special Conditions document takes precedence. Also, at the <br />prebid meeting, all contractors were taken to both piles and both <br />piles were specifically pointed out and discussed with the <br />contractors. Also, Amendment 1, item 11 states in part "the <br />topsoil and overburden growth medium must be replaced evenly to a <br />depth of 6 inches over the entire disturbance or to the extent of <br />the available soil." There is topsoil still available out of the <br />stockpile in question. There has never been a statement that <br />topsoil was only available from 1 stockpile and based upon the <br />evidence it is clear that the OWNER must insist that this 5,000 <br />cubic yard stockpile be used to topsoil the west Side, North End <br />and the East Pit area. <br />3. In regards to the revegetation of all disturbed areas. As no <br />slopes are to be left steeper than 3:1 (horizontal to vertical), <br />the OWNER decided to have the entire site drill seeded as specified <br />in the Invitation and Bid document. The revegetation requirements <br />found in the General Bid Specifications must be followed. Please <br />pay particular attention to the requirements for seedbed <br />preparation which state in part, "The seedbed shall be firm. <br />Trash, weeds and other debris that will interfere with seeding <br />operations shall be removed or disposed of as approved by the <br />PROJECT MANAGER." By this statement, all material that will <br />interfere with drill seeding must be removed or disposed of. There <br />is no doubt that excessively large rock will interfere with drill <br />seeding and must be removed or disposed of. Raking will accomplish <br />this portion of the seedbed preparation. As an alternative, the <br />OWNER is willing to allow a portion of the site to be broadcast <br />seeded if the CONTRACTOR clearly delineates the area to be <br />broadcast, purchases the required additional seed in the correct <br />amount for the area to be broadcast, uses a correct seed mix <br />subject to the OWNERS approval, prepares the seedbed in accordance <br />
