STIPULATIONS <br />Attached to Permit No. C-038-81 <br />Colorado Westmoreland, Inc. <br />Orchard Valley Mine <br />1. Colorado Westmoreland, Inc. must obtain a letter from the State Historical <br />Preservation Office within 30 days of the permit issuance stating whether or <br />not there are any places Zocated within the proposed permit area which are <br />listed or eligible for listing in the National Register of Historic Places. <br />2. Colorado Iestmoreland, Inc. must submit to the Division in final form the <br />vegetation inventory of the Orchard Valley Mine, as outlined in the draft <br />vegetation inventory report by Harney-White Ecological Consultants, Inc., <br />dated August 6, 1981. This final report must be incorporated into the permit <br />application as part of the vegetation appendix in Volume 7. This report must <br />be submitted to the Division within 30 days of the permit issuing. <br />3. The operator is directed by the Division to install the monitoring network shown <br />on Map 28B above the 5 North panel of the 8th East main prior to November 1, <br />1981. In order to determine the adequacy of the simplistic monument proposed <br />for use in this network, the applicant shall install appropriate benchmarks <br />to allow quarterly monitoring of the monument network for a minimum of 9 <br />months prior to mining within the subject panel. Prior to the installation <br />of the monument network benchmarks, the operator shall obtain approval from <br />the Division of the benchmark's location and construction. Following receipt <br />of that approval, the operator shall amend Map 28B to indicate the location <br />of the approved benchmarks. <br />4. The operator shall install and begin monitoring one monitoring well located <br />over the panel to be monitored for subsidence one year prior to mining this <br />panel. The hole shall be completed in the stratum overlying the "D" seam. <br />Water levels in this well shall be monitored monthly as weather permits, and <br />water quality samples shall be drawn twice per year for the parameters listed <br />in Appendix A of this findings document. The operator shall submit to the <br />Division a well completion report, monitoring schedule, ground water level <br />data and water quality data prior to mining tlv s panel. <br />5. The Division directs Colorado [5estmoreland, Inc. to submit reports of its sub- <br />sidence monitoring program on a semi-annual basis, commencing one month after <br />the installation and initial surveying of the subsidence monuments. Further, <br />due to the complexity of the permit area geology, presence of steep slopes, <br />and sensitive hydrologic elements, Colorado Festmoreland, Inc. is directed <br />to submit a proposed subsidence monitoring report format to the Division for <br />approval. This report format should recognize the importance of continual <br />update of subsidence data interpretation, monitoring of ground water Levels <br />and spring flows, monitoring of mine inflow, and subsurface ground conditions <br />which could be correlated to subsidence prediction. This report format <br />shall be approved by the Division prior to the commencement of extraction of <br />coal within the 5 North panel off the 8th East main of the Orchard Valley Mine. <br />6. The operator shall install and be yin monitoring one monitoring well located <br />at drainage node 22, as shown on Map No. 13. The well shall be completed <br />within the bedrock below the surficial material within 60 days of the permit <br />issuing. Water levels, pH, electro-conductivity, and temperature in this <br />well must be monitored monthly as weather permits, and water quality samples <br />shall be drawn quarterly for the parameters listed in Appendix A. This moni- <br />toring data must be submitted to the Division quarterly. The applicant shall <br />submit to the Division a well completion report and monitoring schedule within <br />30 days after the well is completed. <br />7. Within 60 days of permit issuance, Colorado Westmoreland, Inc. must provide <br />the Division with a specific crop production standard for the orchard area. <br />Pending Division approval, this standard will be used in evaluating revege- <br />tation success within the orchard vegetation type. <br />8. Within 60 days of permit issuance, Colorado Westmoreland, Inc. must provide <br />the Division with an appropriate, justifiable shrub/tree density standard which <br />will be sufficient to meet the approved post-mining land use for the reclaimed <br />surface. This standard must be based upon a recommendation from the Division <br />of Wildlife, and must include the findings of the technical references/ <br />sources used to establish this standard. <br />
