June or July and all we <br />had was a guard watching the Mill. <br />Mr. Cole also informed me that he was in his back yard at <br />10:OOpm on Cct. 24th and observed the creek as being dry <br />at tha*. point, he woke up at 3:OOam went outside to <br />attend to some personal business, at which time he <br />observed Cash Greek about to overflow its banks. <br />Given the volume of water that was being discharged and <br />the relative short distance I would estimate the valves to <br />Lave been open no earlier that 9:30pm the eveaing of <br />Oct.24th, and no later than 2:30am the morning of <br />Oct.25th. <br />After observing the water flow I instructed Jimmy Tatman <br />to walk the pipeline containing water coming from the Cast <br />Mine to the tailing pond. He reported back to me that a <br />valve Lad suffered some freeze damage and I assumed that <br />to be the source of the problem. I immediately called <br />Mark Steen and requested he discontinued pumping of the <br />Cast Mine, I then called Eob Mason and left a message on <br />his answering machine to contact me right away. About an <br />hour later I ran into Bob Mascn in front of the <br />General Store and informed him that we had a problem that <br />we Lad traced down to a broken valve and Mark Steen was on <br />hi•~ way to shut the water off. At approximately 11:OOam <br />Mark Steen arrived at the Mill. He then pointed out to me <br />that the vAlvg £rom the tailing pond was open and that he <br />had only cracked it open. I then informed him that as soon <br />as he left the property I had Jimmy turn it off. He then <br />came to the conclusion that instead of Jimmy closing the <br />valve he opened it. <br />In numerous conversations I had with Mr. Steen regarding <br />this matter he has insisted that Jimmy opened the valve. <br />I informed him that if Mark was not the one that opened <br />the valve then we have ghosts up here and Gasper did it. <br />Under Mr. Steen's theory that Jimmy inadvertently opened <br />the valve at noon on Oct,24th, then 480,000 gallons of <br />water would have showed up in Mr. Coles back yard before <br />10:00pm. <br />Qne of the exhibits found in the permit are the results <br />from the portal was Cooper mg/l, 0,1700, Zinc <br />mg/1,37.4000,Lead mg/1,0.2400, Mercury mg/1,<0.0001, PH <br />salid.~ dis_olved mg/1,1,5Q0, suspended mg/1, G10. I am not <br />qualified to comment on the 3amage that occurred but I bet <br />it didn't he'_p matters any. <br />
