DEPARTMENT OF THE INTERIOR now <br /> OFFICE OF SURFACE MINING RECLAMATION AND ENFORCEMENT <br /> FINDING OF NO SIGNIFICANT IMPACT <br /> FOR <br /> Orchard Valley Mine <br /> Federal Lease COC-53356 <br /> Mining Plan Decision Document <br /> A. Introduction <br /> Cyprus Orchard Valley Coal Company submitted a permit <br /> application package (PAP) for a permit revision for the <br /> Orchard Valley Mine to the Colorado Division of Minerals and <br /> Geology (DMG) under the Colorado State program (30 CFR Part <br /> 906) . The PAP proposes extending underground mining <br /> operations into about 522 acres of Federal lease COC-53356. <br /> The proposed mining plan would cause no new surface <br /> disturbance except mining-induced subsidence. <br /> Under the Mineral Leasing Act of 1920, the Assistant <br /> Secretary, Land and Minerals Management, must approve, <br /> approve with conditions, or disapprove the mining plan for <br /> Federal lease COC-53356. Pursuant to 30 CFR Part 746, the <br /> Office of Surface Mining Reclamation and Enforcement (OSM) <br /> is recommending approval of this mining plan. <br /> • B. Statement of Environmental Significance of the Proposed <br /> Action <br /> The undersigned person has determined that the approval of <br /> the mining plan would not have a significant impact on the <br /> quality of the human environment under section 102 (2) (C) of <br /> the National Environmental Policy Act of 1969 (NEPA) , <br /> 42 U. S.C. SS 4332 (2) (C) , and therefore, an environmental <br /> impact statement is not required. <br /> This finding of no significant impact is based on the <br /> attached environmental assessment jointly prepared in <br /> October 1992 by the Bureau of Land Management and OSM. OSM <br /> independently evaluated the environmental assessment as of <br /> this date and determined that it adequately and accurately <br /> assesses the environmental impacts of the proposed action <br /> and provides sufficient evidence and analysis for this <br /> finding of no significant impact. <br /> OSM has reviewed the mitigation measures identified in the <br /> environmental assessment and has determined that the <br /> mitigation measures are either not applicable, have been <br /> completed, or were incorporated into the operation and <br /> reclamation plan contained in the PAP. No surface <br /> disturbance, except for subsidence, will occur in the lease <br /> • area; thus the mitigation measures to protect eagles and <br /> wildlife habitat are not applicable.
