Mid-Term Review 2 November 6, 1985 a. A revised table of contents must be submitted for the permit application. The table of contents must include all additional or revised exhibits and maps, and a list of all supplemental material that has been submitted, including stipulation responses. This information is necessary to insure that the permit application is accurate and complete. Also, any material not currently in the application must be inserted in the appropriate locations. b. Because of the changes in management at the mine the permit application form found in the front of Volume I must be revised to show current names, address, contacts, etc. c. Section 2.03.5 - compliance Information must be updated in accordance with Rule 2.03.5(3), including a statement regarding each violation notice received since the application was filed which describes the following: (a) The date of issuance and identity of the issuing regulatory authority, department or agency; (b) A brief description of the particular violation alleged in the notice; (c) The date, location and type of any administrative or judicial proceedings initiated concerning the violation, including, but not limited to, proceedings initiated by the applicant to obtain administrative or judicial review of the violations; (d) The current status of the proceedings and of the violation notice; (e) The actions, if any, taken by the applicant to abate the violation; and (f) The final resolution of any notice of violation. Soils - Rules 2.04.9, 2.05.3(5), 2.05.4(2)(d) and 4.06 On pages 186-181 of the application the operator made a demonstration, using estimated stripping depths, that there would be enough topsoil available to cover the disturbed areas with 6 (six) inches of topsoil. Since the topsoil has now been stripped and stockpiled, the stockpiles should be surveyed to determine if as much material has been salvaged as the initial calculations had shown to be available.
