<br />Mid-Term Review <br />Animas Mine - Permit No. C-055-82 <br />Introduction <br />This document presents the results of the Division's mid-term <br />Sundance Coal Company's Animas Mine, this mid-term review was <br />fulfill the requirements of Rule 2.08.3, 2.06.2(9), 2.06.3(4), <br />2.06.7(5) and 3.02.2(4). <br />review of the <br />conducted to <br />2.06.5(3), <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, <br />prior to its mid-term (2 1/2 years). Based on this review, for good cause <br />shown, the Division may require reasonable revision or modification of the <br />permit provisions to ensure compliance with the Act and Regulations. <br />Rules 2.06.2, 3, 5 and 7 requires that experimental practices, mountaintop <br />removal variances, variances from AOC, and variances from contemporaneous <br />reclamation be reviewed by the Division where applicable. The Animas permit <br />does not have any operations under these categories. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and <br />the terms of acceptance of the bond every 2 1/2 years. <br />The mid-term review consisted of a detailed review of the Animas Permit <br />application. The Division also reviewed all subsequent revisions and <br />stipulation responses to ensure that all permit commitments and conditions <br />were being followed. Hydrologic monitoring data was reviewed in conjunction <br />with the review of the application to assess the adequacy of the monitoring <br />plan and discussion of hydrologic impacts. Problems and observations from <br />past inspections were also considered while conducting the review. <br />I. Decision to Require Revision <br />The Division has conducted a mid-term review under Rules 2.08.3, <br />2.06.2(x), 2.06.3(4), 2.06.5(3), 2.06.7(5) and 3.02.2(4). The Division <br />finds that certain revisions and modifications are needed to insure <br />compliance with the Colorado Surface Coal Mining Reclamation Act and the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining. The following section details the revisions required and a <br />justification for requiring the revisions. Section II responses should <br />be submitted as a request for minor revisions by December 13, 1985. The <br />responses to our bond concerns should also be submitted by December 13, <br />1985. <br />II. Revisions Required <br />Legal, Financial, Compliance Information Rule 2.03. The Division <br />finds that the following information is inaccurate and needs to be <br />updated to reflect changes that have occurred over the past 2 1/2 <br />years. Specifically: <br />
