the approved disposal site in the Munger Canyon Mine permit azea. <br />SO-3 Permit Transfer application was submitted by LEI on June 26, 2003. The successor <br />operator/pemuttee was Central Appalachia Mining, LLC, (CAM). The Division deemed the <br />application complete and issued a preliminary adequacy letter to CAM on July 3, 2003. The <br />Division was not able to make an affiruiative finding of CAM's legal right of entry until BLM <br />approved the assignment of federal coal leases to CAM. BLM approved the lease transfer effective <br />12/1/04, and the Division issued a proposed decision to approve the SO-3 pernut transfer on <br />November 17, 2004. The pemut transfer decision became final on December 17, 2004. <br />Permit Renewal No. 4 Review Process <br />On Mazch 19, 2002, the Division notified Lodestaz Energy, Inc. (LEI) that mining and reclamation <br />pemrit C-81-020 for the Munger Canyon Mine would expire on January 13, 2003. The Division <br />requested pursuant to Rule 2.08.5, that a renewal application be received in the Division office on or <br />before July 17, 2002. <br />LEI's application for Successive Renewal No. 4 (RN-4) of Permit C-81-20 was received by the <br />Division on April 24, 2002. The application included a renewed certificate of insurance, in addition to <br />the required application form and proposed newspaper public notice. The application was deemed <br />complete on May 9, 2002, and notices were provided to various local, state, and federal agencies on <br />that date. <br />Public notice of the renewal application was published in the Grand Junction Daily Sentinel once a <br />week for four consecutive weeks beginning May 17, 2002. Proof of publication was provided to the <br />Division on June 10, 2002. The Division received only one written comment during the review period. <br />The Division's adequacy review was conducted with the following sequence of notification letters, <br />adequacy review letters, response submittals, and associated correspondence. There was a substantial <br />delay in the review period, which was due to the bankruptcy of LEI, and subsequent delays associated <br />with transfer of federal coal leases from LEI to CAM. <br />May 9, 2002--availability for review and request for comments provided to Bureau of Land <br />Management Grand Junction Resource Area (BLM), Garfield County Commissioners, Colorado Dept. <br />of Health Air Pollution Control Division, Garfield County Planning Department, Colorado Geological <br />Survey, Colorado Division of Water Resources, Colorado Division of Wildlife (DOW), U.S. Army <br />Corps ofEngineers, State Board ofLand Commissioners, Office of Surface Mining Western Regional <br />Coordinating Center (OSM), Natural Resources Conservation Service Grand Junction Field Office <br />(NRCS), Colorado Dept. of Health Water Quality Control Division, Colorado Historical <br />Society/Historic Preservation Officer (SHPO), and U.S. Fish and Wildlife Service. <br />May 23, 2002-DMG received a comment letter from SHPO indicating that approval of the renewal <br />application would not affect cultural resources. <br />
