Box 1458 ' <br />Glenwood Springs, Colorado 81601 <br />Re: Blue Pit Amendment - Zemlock and Son, Inc., Permit No. 81-207 <br />Dear Mr. Gamba: <br />The Division has reviewed the amendment to the above referenced permit. <br />Included in this review was a thorough examination of the approved <br />permit. The following questions and comments are based on this review. <br />This amendment has been scheduled before the Mined Land Reclamation Boaro <br />at the September 22, 1983 meeting. To allow for review time by the <br />Division of your responses, please address the following, point-by-point, <br />by September 1, 1983. <br />A. Exhibit C - Maps <br />1. When the original permit was reviewed, inadvertently the haul <br />road from Garfield County Road 104 to the project boundary area was not <br />~., included as affected acreage and permitted. As stated in your <br />~'~ correspondence of December 14, 1981, "...the road... will be improved for <br />;• use as an access road to the project". Because of this, the road is <br />o ~.y~lassified as affected acreage and, therefore, must be included in the <br />~~ ~ permit area. How many acres does this road encompass? Please include <br />~Q`N,r, this amount into the total permitted acreage. (If you have any questions <br />regarding the amendment fee associated with this additional acreage, <br />please call me.) <br />The Division has never received the agreement between the <br />~~j operator and Basin Ditch as addressed in your correspondence of December <br />14, 1981. Please supply this agreement. <br />Due to the close proximity of the Holy Cross Electric Company <br />power poles and power lines to this operation, an agreement pursuant to <br />a~ C.R.S. 1973, 34-32-115(4)(4) is needed. Inadvertently this agreement was <br />not requested before but it is necessary. This agreement between the <br />operator and the power co~any is so that if there is damage to the power <br />poles and/or lines, this damage will be cong~ensated for by the operator. <br />423 Centennial Building, 7313 Sherman Street Denver.
