The stipulation reads as follows: <br />"Prior to any disturbance in the Energy Mine No. 3 Area, the <br />permittee must submit to the Division proof that the Energy Mine <br />No. 3 Detention Basin NPDES discharge point has been <br />reactivated." <br />CYCC has taken action to reactivate discharge point 010 of NPDES Permit <br />CO-0027154 to allow discharge from the Mine No. 3 Detention Basin. Please see <br />the attached letter to the Colorado Water Quality Control Division. Under the <br />terms of the NPDES Permit, application for designation of a discharge point must <br />be made 90 days prior to the proposed time of discharge, to allow the CWQCD time <br />for review. Discharge from the Mine No. 3 Detention Baisn is not expected to <br />occur until the spring runoff season in March of 1985. CYCC will forward a copy <br />of the approval letter from the CWQCD to the CMLRD when it is received. <br />This letter and attachment should satisfy the requirements of Stipulation <br />No. 12.
