The request is made because Phase II of <br />the geotechnical and stability analysis of the surface facilities has not <br />shown that imminent danger has been found at Orchard Valley Mine. The <br />analysis of the stability and drainage have shown some problems to exist, <br />but failure would not result in danger to the health or safety of the <br />citizens of the State of Colorado. Rather than immediately beginning <br />Phase III as directed in the stipulation, CWI proposes to do the <br />following. <br />A prediction of the consequences of a failure in the diversion chan- <br />nel was analyzed and submitted to the Division on April 15, 1982. This <br />work was performed by Geo-Hydro, Merrick and Associates and CWI <br />engineering. CWI further proposes that additional monitoring be done on <br />the areas as outlined in the Phase II stability analysis report. The <br />monitoring would be through use of inclinometers and pore water pressure <br />measuring devices. Geo-Hydro will direct the monitoring effort and <br />analyze for water and movement. Reports on this monitoring will be <br />submitted to the Division on a quarterly basis. CWI personnel will <br />monitor the instruments on a monthly basis. <br />The existing stability analysis bore holes will be monitored for <br />ground water on a monthly basis. This information will be submitted to <br />the Division on a quarterly basis. If CWI or Geo-Hydro suspects an im- <br />minent hazard, CWI would take immediate measures to protect the health <br />and safety of the citizens and protect the environment. <br />Because of CWI's requirement to stockpile coal on the crushing and <br />screening level, CWI will do the following additional requirements. <br />CWI is in the process of installing warning signs at the bottom <br />of the crushing and screening level.
