COM, Inc. <br />is conditionally approved to bring Mule Vein (i.e. Mogul Tunnel) ore to the Gold <br />Hill Mill for further testing ...." (Parenthetical information added). <br />IS July '94 Boulder County sends letter to W. Tatman of COM, Inc. stating, "... we wish to <br />state our position that milling ore imported from other mining sites constitutes <br />custom milling, which is an industrial use ... not permitted in the Forestry <br />District." <br />LS July '94 Boulder County sends letter to W. York-Feirn of MLRD stating, "It is our <br />position that milling ore imported from other mining sites constitutes custom <br />milling, which is an industrial use, and is therefore not permitted in the Forestry <br />District." The letter further requests the County to be provided copies of certain <br />COM, Inc. submittals to MLRD. <br />25 July '94 Colo. Division of Minerals and Geology (MLRD) inspection report lists eighteen <br />(IS) completed corrective actions concerning problems identified in the IS June <br />'94 inspection report. It was agreed that Operator would sample both the top <br />and bottom of monitor wells and submit results on a quarterly basis for a <br />year. This has never been accomplished. <br />27 July '94 G. Fraser of COM, Inc. replies to Boulder County letters of 5 July '94 and IS <br />July '94, stating that COM, Inc, has complied with the Colo. State definition of <br />a custom mill, that misc. junk has heen removed, and requesting an extensic of <br />time to remove trailer. <br />4 Aug. '94 Boulder County sends letter to G. Fraser of COM, Inc., in reply to Fraser's letter <br />of 27 July, giving 30 days to remove camper, reiterating County position <br />against imported ore and requiring its discontinuance. Also states that <br />milling is an allowable accessory use to mining, but not an allowable <br />principal use. <br />4 Aug. '94 Gold Hill Mill is operating at approximately 18 tons per day or 37% of capacity. <br />Boulder County continues in its previously-stated position that milling of imported <br />ore constitutes an industrial use not permitted in the Forestry Zone. State of <br />Colorado Division of Minerals and Geology gives conditional approval of <br />importation of ore, provided that mineralogic analysis and legal ownership of ore <br />by COM, Inc. requirements are met. <br />l4 Aug.
