Stipulation #18 Due to the recalculated volume of the temporary overburden stockpile, and due to the possibility of not obtaining the Sudduth lease, Kerr Coal must demonstrate within 90 days of permit renewal that approximate original contour can be achieved. This submittal must include all applicable maps, tables and pertinent calculations to fully demonstrate the achievability of aoc. Status: Terminated 12-9-1992. Stipulation # 19 Kerr Coal has submitted detailed bonding liability cost estimates in response to the Division's preliminary determination. The Division is reviewing bond liability estimates submitted by Kerr and the Division in conjunction with Kerr, the Division is to make a determination of cost estimates to be used in estimating the total bond amount. Total bond for the mine site (15` increment) is set at $4,290,800.00 and Ken• is to maintain a bond in that amount in full force and effect no later than 60 days after issue of the Division's decision on permit renewal. The Division will determine additional amounts which may be required, if any, for the Kerr site. When an amount is agreed upon, this amount will be submitted as a new bond or rider to the existing bond pursuant to Rule 3.02. Status: Terminated 5-14-1996 Stipulation #21 Within 30 days of approval of MR25, Kerr Coal Company will submit text page 816-1758, clarifying that map 29 depicts the tipple azea haul roads only and that haul roads A and B were modified via MR-25 to permanent light use roads, as depicted on map 28A -Mine Area Existing Structures. Map 28A should be cleazly labeled to show that both previous haul road segments aze now permanent light-use roads. The revision number should be included at the bottom of the text pages. Text should be added discussing reclamation sequence. Status: Complied with 11-28-1995 Stipulation #22 The operator is required to provide a complete inventory of all wells within the permit boundary including the following: (A) well log and completion information, including borehole diameter, casing type, well depth, gravel pack and grout intervals; (B) ground conditions including access to wells; (C) water level measurements; (D) depth of each well, condition of borehole/casing and amount of sediment in each well; and (E) a summary of how and when each well will be sealed.
