<br />This document presents the results of the Colorado Division of Minerals and <br />Geology's (the Divisicn) midtern r_viety cf the Colorado Yampa Coal Company <br />Mine No. 3. This midterm revie,a ~.aas conducted to fulfill the requirements of <br />Rules 2.08.3, 2.06.2(9), 2.06.3(4), 2.06.5(3), 2.06.7(5) ar.d 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued <br />prior to the middle of the permit term. Based on this review, for good cause <br />shown, the Division may require reasonable revision or modification of the <br />permit provisions to ensure compliance with the Act and Regulations. <br />Rules 2.06.2, 3, 4, 5 and 7 require that experimental practices, mountaintop <br />removal variances, steep slope mining, variances from AOC and variances from <br />contemporaneous reclamation be reviewed by the Division where applicable. The <br />CYCC Mine No. 3 permit does not include any operations under these variance <br />categories. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and <br />the terms of acceptance of the bond every two and one-half years. <br />The midterm review consisted of a detailed review of the CYCC Mine No. 3 <br />findings document and permit application to identify any items that may have <br />been overlooked during the initial review. The Division has also reviewed all <br />subsequent revisions and stipulation responses to ensure that all permit <br />commitments and conditions were being followed. Hydrologic monitoring data <br />were reviewed in conjunction with the review of baseline data to assess the <br />adequacy of the monitoring plan. Finally, the Division has conducted a recent <br />on-site inspection of the mine in addition to a detailed review of past <br />inspection reports to ensure consistency of the mine plan with field <br />conditions and to identify any potential problems requiring attention. <br />This document is organized in five sections: Section I provides a summary of <br />the current mine permit status. Section II includes a listing by category of <br />what items need to be revised, a rationale for requiring these revisions and <br />timetables for completing these revisions. Section III summarizes the <br />revisions to the permit processed to date and the action taken by the <br />Division. Section IV presents a summary of the status of the stipulations <br />attached to the CYCC Mine No. 3 and any revisions required with regard to the <br />stipulations. Section V presents the result of the bond review required under <br />Rule 3.02.2(4). <br />I. Review of CYCC Mine No. 3 at Midterm <br />Colorado Yampa Coal Company's Mine No. 3 received its permanent program coal <br />mining permit (C-84-062> from the State of Colorado on October 4, 1984. The <br />permit ~nas for a five-year term. On November 5, 1990, the Division renewed <br />the permit for Mine No. 3 for another five-year term. <br />Only reclamation work has been done cn the property since the permit was <br />issued. CYCC has Sealed and backfilled the Middle Creek underground mine <br />portal area. Backfilling and rough grading of all other areas of the mine was <br />completed in 1986. Topsoil redistribution was completed in 1986 for all parts <br />of the mine except the 'piddle ''r=;'< •='=°,r- area. Seeding has been done on <br />all areas except the M'dd'e ''r =': _f ,- ce area. <br />
