The original permit for the Blue Ribbon Mine was obtained by Sunflower Energy
<br />Corporation in 1977. The application was submitted in November 1976, amended in August
<br />1977, and subsequently approved later in 1977.
<br />Sunflower Energy Corporation submitted a permit application to comply with the provisions
<br />of the Colorado Permanent Program requirements on February 17, 1981. This application
<br />was found to be complete on February 27, 1981, and the Division's Preliminary Adequacy
<br />Review comments were sent to the operator on Apri123, 1981. On May 20, 1981, the Blue
<br />Ribbon Coal Company succeeded Sunflower Energy Corporation as operator of the Blue
<br />Ribbon Mine.
<br />Blue Ribbon Coal Company was a Colorado Partnership. The partners included Hawk
<br />Mining, Inc., North Fork Energy Corporation, and Cedar-Crest. Western Associated Coal
<br />Corporation managed the partnership's business.
<br />Blue Ribbon Coal Company submitted the Preliminary Adequacy Review response on
<br />October 8, 1981. Additional review comments were forwarded from the Division to the
<br />operator on November 30 and December 4, 1981, and the Division received responses from
<br />Blue Ribbon Coal Company on January 5, 1982, May 17, 1982, and July 27, 1982. These
<br />responses satisfied issues raised during the review processes. The final decision to approve
<br />the permit application was made December 8, 1982.
<br />An application to renew the permit was submitted on June 15, 1987. It was found to be
<br />complete on June 15, 1987, and the Division's preliminary adequacy review was sent on
<br />August 6, 1987. Blue Ribbon Coal Company submitted responses to the adequacy review
<br />on August 31, 1987. The Division made a decision to approve the permit renewal on
<br />November 20, 1987 and the permit was issued on January 15, 1988.
<br />On January 3, 1990, MINREC, Incorporated, succeeded Blue Ribbon Coal Company as
<br />operator of the Blue Ribbon Mine.
<br />A second permit renewal was applied for by MINREC, Inc. on July 6, 1992 and was found
<br />to be complete on July 13, 1992. The Division's preliminary adequacy review was sent on
<br />September 2, 1992, and MINREC's responses were received on October 19, 1992, in the
<br />form of a technical revision. The technical revision, which addressed the issues raised in the
<br />preliminary adequacy review was approved on December 18, 1992, and the permit was
<br />subsequently issued.
<br />The renewal permit was issued on December 18, 1992, with the new expiration date set at
<br />December 9, 1997. The midterm date for this five year permit term is June 9, 1995.
<br />Since permit renewal, one Notice of Violation was issued. On April 6, 1993, Notice of
<br />Violation C-93-033 was issued for failure to maintain stability of cover material and
<br />underlying refuse material on the south side of the mine bench face. The violation was
<br />modified on April 28, 1993 to include an additional slump on the north side of the mine
<br />bench which only disturbed cover material. The violation was also modified to include coal
