<br /> <br />SECTION FOUR <br />4.1. Taxes. <br />Sellers shall pay all real Property taxes <br />levied or assessed upon the Property, existing improvements, <br />and a:ny improvements placed thereon by Sellers. However, Sellers <br />shall not be liable for taxes on any tools, equipment, machinery, <br />facilities or improvements placed upon the Property by Buyers <br />unless Buyers fails to remove them within the time provided <br />by this agreement in section two 2.5.. <br />SECTION FIVE <br />Termination and Default <br />5.1. Termination. Buyers shall have the right to abandon <br />and terminate this agreement at any time. However, upon <br />terminating the agreement, Buyers must give thirty (30) days <br />written notice. Buyers shall thereafter be relieved of all <br />obligation and responsibilities and the agreement shall be <br />terminated. Buyers will provide Sellers with all factual data <br />collected on the Property. <br />In the event of a voluntary termination by Buyers, Buyers <br />shall surrender possession of the Property to Sellers and shall <br />have no further liability or obligation under this agreement <br />except for its obligation to pay any moneys or royalties then= <br />owed to Sellers, and any money owed for materials, labor or - <br />any cost accrued in the mining operations including the cost <br />of removal of all equipment as stated in section two 2.5. and <br />all responsibilities with regards to the reclamation requirements <br />shall be the duty of Buyers.
