Box 17304 <br />Boulder, CO 80308-0304 <br />Re: Adequacy of the Permit Application, Colina Oro Molina (COM), Inc., <br />Gold Hill Mill, File No. M-94-117 <br />Dear Mr. Hartley: <br />The following items remain to be addressed for the bivision to approve the <br />above referenced application. As you know, the Mined Land Reclamation <br />Board has indicated that Permit No. M-83-141, Gold Hill Mill and Mines, <br />will be revoked if a separate permit for the Gold Hill Mill is not <br />obtained. A revocation hearing is scheduled for Thursday morning, June <br />22, 1995, commencing at 9:00 a.m. The hearing will be held in Room 318, <br />1313 Sherman Street, Denver, Colorado. <br />1. The most recent permit information submitted by COM, Inc. was <br />received at Division offices on June 2, 1995. Map E-1 included with <br />that submittal depicts a topsoil pile below the tailing dam at the <br />southwest end. To the Division's recollection, this is actually a <br />pile of slash left from previous land clearing, and the only topsoil <br />pile currently at the site is across the road to the southwest. <br />Please clarify the slash pile/topsoil pile locations at the site, <br />submitting revised maps if necessary. <br />2. The land ownership map included with the 6/2/95 submittal depicts a <br />permit boundary that encompasses portions of the Lillie of the West <br />Lode and the Gold View No. 1. The Division cannot locate <br />documentation of legal right to enter these claims in any of the <br />COM, Inc. submittals. There may be other claims within the proposed <br />permit boundary for which adequate legal right to enter has not been <br />demonstrated. Given the typically confusing land ownership picture <br />that exists in a historic mining district such as Gold Hill, it is <br />imperative that the Division be provided a clear demonstration of <br />legal right to enter all lands proposed to be included within the <br />permit boundary. The best way to satisfy this requirement may be to <br />list each claim to be included in the permit boundary, along with <br />the name of the owner of each claim, and specification of the <br />mechanism by which COM, Inc. has been provided legal right to enter, <br />
