Mr. Robert F. T. Krassa - 4 - July 26, 1993 <br />The Division would now like to provide responses to these items, in order of <br />their enumeration provided herein: <br />Evaluation of this particular concern required evidence of Raton West <br />property boundaries in relation to the Golden Eagle Mine permit <br />boundaries. The Division requested this information from your offices on <br />February 8, 1993, which we received on March 3, 1993. <br />It is evident from information provided by your office and Basin Resources <br />that the Sections of, land where Raton West property (the Rancho Escondido <br />subdivision) and the Golden Eagle Mine's permit boundaries overlap are <br />Sections 17, 18, 19, and 20 of Township 335, Range 67W, 6th P.M. <br />In May of 1987, the area known now as Rancho Escondido was owned by the <br />Picketwire Ranch, as shown on Basin Resources' "Map 1, Surface Ownership", <br />received by the Division on May 18, 1987. Sometime between May 1987 and <br />March 1990, the property belonging to the Picketwire Ranch in Section 18 <br />became Rancho Escondido, as evidenced by an update to Map 1, received by <br />the Division on March 6, 1990. A portion of Picketwire Ranch's property <br />in the north half of Section 19 also became Rancho Escondido, while <br />Picketwire Ranch's holdings in Section 17 became the property of <br />Pinon Valley Development Corp. The majority of the property owned by <br />Picketwire Ranch in the south half of Section 19 became the property of <br />Mr. Wilson Foreman. <br />In 1988 and 1989, Wyoming Fuel Company began developing the Third North <br />Main. This set of tunnels now links the main underground workings <br />situated to the south of the Purgatoire River with the workings being <br />developed on the north side of the river. In 1989, Wyoming Fuel Company <br />applied to expand their permit boundary in the area north of the river, <br />under Permit Revision PR-Ol, to include portions of Sections 15, 16, 17, <br />18, 19, 20, 21, 22, 27 and 28. This application was approved on July 2, <br />1990. Development mining first reached Lot 10 of Ranch Escondido on <br />August 25, 1990, and Lot 1 on October 11, 1990. Longwall mining began <br />under Lot 1 in May of 1991, and retreated from under the southeast corner <br />of Lot 10 in September of 1991. <br />It is apparent from this that at the time Wyoming Fuel Company had applied <br />to the Division for expansion of its permit area under Permit Revision <br />PR-Ol, Raton West did not own Ranch Escondido, and as such would not have <br />received notice from Wyoming Fuel of its proposed operations. It is also <br />apparent that as Raton West purchased Lots 1 and 10 of Rancho Escondido on <br />December 31, 1991, Wyoming Fuel Company had already notified the previous <br />owners of these lots and had undermined these tracts of property prior to <br />Raton West purchasing the property. Wyoming Fuel (now known as Basin <br />Resources) is currently mining near the intersection of Sections 20, 21, <br />28 and 29. <br />It is not apparent to us when Trinidad National Bank became the owner of <br />Rancho Escondido. Please provide these dates for us, so that we may <br />provide a more appropriate response. <br />
