Basin Resources has failed to provide relatively current required maps, <br />which are needed as a basis for surface owner notification and other <br />purposes, specifically: <br />a. a map of surface ownership included in or contiguous to the permit <br />area, as required by Regulation 2.10.3(1)(a), <br />b. a map of surface disturbances caused by subsidence associated within <br />the permit area, as required by C.R.S. 34-33-111(I)(a) and <br />Regulations 2.05.3<2)(b) and 2.10.3(1)(c>; and <br />c. a map illustrating an evaluation of surface uses per Regulation <br />2.04.3(2)(a), as the existing map is inadequate and out of date. <br />22. Basin Resources has failed to comply with reclamation plan requirements <br />regarding impacts on the local hydrologic system, which includes surface <br />water and ground water, as required by C.R.S. 34-33-111(1>(m) through <br />34-33-121(2)(i> and Regulations 2.05.6(3) and 4.20.4. <br />23. Basin Resources has failed to provide in its application a statement of <br />the condition of the land to be covered by the permit prior to any surface <br />coal mining operations, as required by C.R.S. 34-33-111(1)(b) and <br />Regulation 2.04.3. <br />24. Basin Resources has failed to provide statements and documentation to <br />right of access, as required by C.R.S. 34-33-110(2)(j> and <br />Regulation 2.03.6. <br />25. Basin Resources has failed to comply with county regulations regarding <br />building permits, as required by C.R.S. 34-32-109(6); <br />26. Basin Resources has failed to submit and maintain a complete permit <br />application, as required by C.R.S. 34-32-109; <br />27. Basin Resources has failed to comply with all applicable county <br />regulations (no citation listed); <br />28. The Office of Mined land Reclamation should order Basin Resources to cease <br />operations at the Golden Eagle Mine, per C.R.S. 34-33-121(3) <br />(1984 Repl. Vol. 14 and Cam. Supp. 1992), C.R.S. 34-24-109 and <br />C.R.S. 34-48-102. <br />
