REQUEST FOR TECHNICAL RE4ISION <br />The following items will need to be addressed in order to ensure continued <br />compliance with the Act and the Rules. <br />1. Changes to the Identification of Interests regulations (2.03.4), which <br />rely on a definition of "OWNS OR CONTROLS" and "OWNED OR CONTROLLED" <br />(Rule 1.04(83a)) have been approved by OSM and the Mined Land' Reclamation <br />Board, and are now in effect. Copies of these revised Rules are attached <br />to this document. Therefore the list of Officers and Directors (Tab 3, <br />Attachment 3-7) and probably the list of Princi ple Sharehol ders <br />(Attachment 3-12) need updating. In conjunction with this revision please <br />indicate on a replacement page where documents are currently being filed <br />for public viewing. Any changes lif any) to surface or coal ownership, <br />other lease hold interests, and related information should also be made at <br />this time. It is requested thatPeabody provide this information as a <br />Minor Revision to the permit within 60 days of the date of this document. <br />2. A recent change to Rule 4.05.6 (sedimentation ponds) has also been <br />approved by the Board and by the Office of Surface Mining, and a <br />grandfathering clause for existing ponds has been rejected by OSM. <br />Rule 4.05.6(3)(d) now requires either a combination of separate primary <br />and emergency spillways, or a single combined open-channel spillway. A <br />copy of the revised rule is enclosed. At the Nucla Mine, existing Ponds <br />002, 004, 005, 006, and the design for proposed pond 007 all are equipped <br />with combination pipe spillways, which are not allowed by the revised <br />performance standard. Updated designs for these ponds must be submitted <br />as a Technical Revision, and the ponds must be in compl fiance with the new <br />standards by September 1 , 1991. <br />/ er n <br />9933E <br />
