ENFORCEMENT-ACTIONS <br />Two enforcement actions have been taken by the Division since the permit <br />renewal in May, 1988. <br />NOV C=90=035: Rules 4.05.5(1) (a ), 4.05.5(1) (c ), 4.06.3(2) (a) (i ). Failure to <br />design, construct, and maintain aDDropriate sediment control measures for <br />topsoil stockpiles 8 and 13 in order to prevent additional contributions of <br />sediment to stream fl ow or runoff outside the permit area, and to minimize <br />erosion and provide protection for topsoil . Issued August 27, 1990, <br />terminated November 5, 1990. <br />NOV C=90=036: Rules 4.05.6(8)(f) and 4.05.9(6). Failure to vegetate and <br />stabil ize embankments and areas surrounding sediment ponds 002, 004, and 005. <br />Issued August 27, 1990, terminated November 5, 1990. <br />BONDING <br />The Division currently holds reclamation bond in the amount of $1,730,280.00, <br />while the current bond liability is 51,420,004.00 according to the Division's <br />calculations. The band is therefore considered sufficient to reclaim the <br />projected worst-case disturbance during this five-year permit term. <br />REVIEW OF VARUkNCES <br />There are no variances currently in effect at this time for the Nucla Mine, <br />7 <br />
