BRI did not request bond release for the Third North ventilation shaft and the NW-1 bleeder fan in <br />this bond release application. The bond amount associated with each of [hese facilities is included in <br />the subtotal amount of $1,153,959.00. An application for Phase (bond release was <br />received by the Division on September 3, 1997. The application was deemed complete on <br />September l0, 1997, as BRl filed proof of publication of the public notice concurrent with the <br />application. BRI published notice of the bond release application in Chronicle News once weekly <br />for four consecutive weeks, beginning July 15, 1997. BRI also notified land owners within and <br />adjacent to the mine permit area, and other interested parties, of the application for bond release, as <br />required by Rule 3.03.2((). <br />One private landowner in the adjacent Rancho Escondido development objected to the bond release <br />request. This objection was received August 11, 1997. This landowner was not adjacent to the <br />disturbed area subject to the bond release but was adjacent to the large block of land owned by~Rl. <br />Furthermore, the objection was not concerning the reclamation work performed at the main mine <br />facility area. The landowner was objecting to reclamation work performed on his property under a <br />Notice of Intent (NOI). As stated above, ac[ivities transferred to a Notice of Intent under TR-47 are <br />excluded from this bond release and remain fully bonded at this time. On behalf of this landowner, <br />the Rancho Escondido Property Owners Association (REPOA) requested an informal conference on <br />August 29, 1997. On September 10, 1997, the Division notified REPOA that the landowners <br />concerns were not part of this Phase I bond release request and that no bond monies would be <br />released concerning reclamation on this landowners property. On October 3, 1997, the Division <br />received a letter from REPOA withdrawing their request for an informal hearing. The Division <br />
