PROPOSED DECISION <br />As required by Rule 3.03.2(S)(a), this document constitutes written notification of the Division of <br />Minerals and Geology (Division) decision to approve a Phase [bond release request (SL-Ol) for the <br />Golden Eagle Mine, permit rY C-8l-O13, submitted by Basin Resources, [nc. (BRI). The rationale <br />for this approval are as outlined below. <br />BACKGROUND <br />The Golden Eagle Mine is a reclaimed underground mine which is permitted and operated by Basin <br />Resources, Inc. (BRI). The mine is located in Las Animas County, approximately 4 miles west of <br />the town of Weston, in portions of sections 15-22 and sections 27-34, T33S, R67W. The mine <br />ceased coal production on December 31, 1995 and demolition and reclamation was conducted during <br />1996 and early 1997. 59 acres were disturbed and reclaimed at this site. The land for which bond <br />release has been requested is privately owned by BRI. Reclamation of areas for which bond release <br />has been requested was completed during late 1996 and early 1997. The areas to which this bond <br />release request applies are all disturbed areas within the permit area located in T33S, R67W, <br />sections 28,29,32, and 33, excluding any outlying disturbed areas associated with developmental or <br />exploration drilling, the Third North ventilation fan, and the NW-1 Exhaust shaft. These excluded <br />areas remain 100% bonded. <br />At the cessation of mining activities in December of 1995, the performance bond required to be <br />held by the Division for reclamation was $1,490,512.00. Technical Revision It47 (TR-47) modified <br />the required bond amount to be held by the Division, as shown below in Table A. First, two <br />structures, the river intake ponds and the associated pumphouse were approved to remain to allow <br />development of the adjudicated water right held by the landowner. Second, TR-47 reduced the <br />required bond to be held by $179,970.00 for developmental drilling sites that were approved but not <br />constructed.
