11. The Division has made a negative determination for the presence of prime <br />. farm land within the permit area. The decision was based on mapping by <br />the O.S. Soil Conservation Service which demonstrates that no prime <br />farmland mapping unite are found within the permit area (2.07.6(2)(k)). <br />12. Based on information provided in the application the Division has <br />determined that an alluvial valley floor exists within the permit or <br />adjacent area. The alluvial valley floor is known ae the North Fork of <br />the Gunnison River Alluvial Valley Floor (2.07.6(2)(K) and 2.06.8(3)(C)). <br />For additional specific findings concerning this alluvial valley floor, <br />please see Section B, VI. <br />13. The Division hereby approves the post-mining land use of the irrigated <br />cropland. It was determined that this land use meets the requirements of <br />Rule 4.16 for the permit area (2.07.6(2)(1)). <br />14. Specific approvals have been granted These approvals are addressed in <br />the following section, Section B (2 .07.6 (2)(m)1. <br />15. The Division finds that the activities proposed by the applicant would not <br />affect the continued existence of endangered or threatened species or <br />. result in the destruction or adverse modification of their critical <br />habitats (2 .07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees <br />Branch. As of this time, Terror Creek Company, the operator, is current in <br />the payment of reclamation fees required by 30 CFR Chapter VII, <br />subchapter R (2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4: <br />Roads - Rule 4.03 <br />A. Haul Roads <br />Information pertaining to roads can be found on pages 2.05-SR <br />and 2.05-9, and Maps 5 and 9. The haul/access road at the <br />loadout connects the facilities with State Highway 133. Road <br />cross sections and profile drawings are presented on Map 9. The <br />location of road drainage ditches and culverts is provided on <br />Map 14. <br />The Division proposes to approve the retention of a portion of <br />the haul road which leads to the office area (depicted on Map <br />10) because the road is compatible with the approved post-mining <br />land use, and a request for its retention was submitted by the <br />landowner. The office and garage will remain after the loadout <br />has been reclaimed and will be converted to a residence and <br />garage following reclamation. Therefore, retention of the road <br />is required to provide access. In addition, this roadway will <br />provide access for two adjacent landowners since Delta County ie <br />planning to abandon County Road 4365. The roadway is <br />approximately 400 feet long and 24 feet wide. <br />The lower portion of the haul road which enters the coal loadout <br />pad will be reclaimed following cessation of mining activities. <br />Terror Creek has obtained a Permit for Access from the State <br />Highway Department for the highway approach and a License <br />Terror Creek Loadout Page 9 <br />
