2005 Midterm Review <br />Foidel Creek Mine <br />Permit C-1982-056 <br />BECTON I -INTRODUCTION <br />Purpose <br />The Colorado Division of Minerals and Geology (Division) conducted this review for the <br />purpose of fulfilling the requirements of the Colorado Surface Coal Mining Reclamation Act <br />(Act), and the Regulations of the Colorado Mined Land Reclamation Boazd for Coal Mining <br />(Rules); specifically the requirements of rules 2.08.3, 2.06.2(10), 2.06.3(4), 2.06.5(3), 2.06.7(5) <br />and 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued by the middle of <br />the permit term. The current permit C-1982-056 extends from May 23, 2003 to May 23, 2008, <br />midterm being November 19, 2005. Based on this review, for good cause shown, the Division <br />may require reasonable revision or modification of the permit provisions to ensure compliance <br />with the Act and Regulation. <br />Rules 2.06.2, 2.06.3, and 2.06.5 require that, where applicable, experimental practices, <br />mountaintop removal variances, and variances from approximate original contour (AOC) for <br />steep slope mining, respectively, be reviewed by the Division during the Midterm Review. Rule <br />2.06.7(5) requires a review, no later than 3 yeazs from the date of issuance of the permit and any <br />permit renewals, of a variance granted for delay in contemporaneous reclamation requirements in <br />combined surface and underground mining operations. Of these, the Foidel Creek Mine permit <br />includes variances from contemporaneous reclamation for combined surface (a historic surface <br />mining operation, Colorado Yampa Coal Company Permit C-1981-071, incorporated into the <br />permit) and (current) underground operations. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and terms of acceptance <br />of the bond every two and one-half years. <br />The midterm review consisted of a detailed review of the Foidel Creek Mine permit application, <br />findings document, revisions since the last permit renewal (RN), outstanding stipulations, and <br />permit commitments and conditions. Field inspection reports over the past yeaz were also <br />reviewed to ensure consistency of the mine plan with field conditions. <br />This document presents the results of this review. It is organized into three sections, this <br />introduction (Section I), Section II- Summary of Permit Revisions, Violations, Stipulations, <br />Variances, and Bond; and Section [II -Requested Revisions of Permit Application. <br />2005 Midterm Review, Permit C-1982-056, Foidel Creek Mine, Page 2 of 9 pages, November 17, 2005 <br />
