<br />Proposed Decision <br /> <br />The Colorado Mined Land Reclamation Division proposes to approve with <br />stipulations an application for renewal of a valid existing permit. The <br />application was submitted by The Pittsburg & Midway Coal Mining Company for <br />the Edna Mine. This decision is based on a finding that the operations will <br />comply with all requirements of the Colorado State Program as found in the <br />Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and <br />the Regulations promulgated pursuant to the Act. If no request for a formal <br />hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final, at which <br />time the permit will be issued. The permit application, all supporting <br />documentation and any stipulations or conditions will become a binding part of <br />the permit. <br />Two stipulations are in effect for the Edna Strip Mine: <br />Stipulation No. 31 <br />The Permittee shall complete the construction of the West Ridge <br />Hydrologic Reconstruction Plan, as described in Permit Revision No. 2, no <br />later than October 31, 1995. By October 31 of each year until then, the <br />Permittee shall submit a report to the Division describing the progress <br />on the plan during the construction season of that year. Only by written <br />agreement of the Division may the construction deadline be altered, and <br />then only in the event of climatic or other circumstances beyond the <br />control of the operator. <br />The stipulation was placed on approval of the West Ridge Hydrologic <br />Reconstruction, Permit Revision No. 2. <br />Stipulation No. 32 <br />Within 60 days of issuance of the renewed Edna Mine permit, the permittee <br />shall submit a complete technical revision application to the Division. <br />The revision shall update the probable hydrologic consequences analysis <br />in the permit to incorporate results of past water monitoring in the <br />permit area and to evaluate those results in terms of impacts to the <br />hydrologic balance. The revision shall also amend the hydrologic <br />monitoring plan for the mine to ensure that adequate data is obtained to <br />continue to meet the requirements of Rule 2.05.6(3). The modifications <br />to the monitoring plan shall, at a minimum, address collection of <br />adequate flow data, total dissolved solids and specific conductivity data <br />from surface and alluvial well sampling locations along Trout Creek. <br />This stipulation is placed on this decision for the second permit renewal. <br />The January 14, 1987 Findings Document listed the following stipulations <br />imposed on the Division decision to renew the first Edna Mine permit renewal <br />
