<br /> <br />11. The Division has made a negative determination for the presence of <br />prime farmland within the permit area. The decision was based on an <br />August 21, 1978 letter from the Soil Conservation Service that states <br />that no prime farmland mapping units are found within the permit area <br />(2.07.6(2)(k)). <br />12. Based on information provided in the application, the Division has <br />determined that alluvial valley floors exist within the permit or <br />adjacent area. The alluvial valley floors are along Trout Creek and <br />Oak Creek and will be affected indirectly, resulting in minor <br />dewatering of the alluvium and possible water quality impacts <br />(2.07.6(2) and 2.06.8(3)(C)). <br />For additional specific findings concerning alluvial valley floors, <br />please see Section B, part XVII of this document. <br />13. The Division hereby approves the post-mining land use of the <br />operation. It was determined that a restoration to rangeland and <br />wildlife habitat meets the requirements of Rule 4.16 for the permit <br />area (2.07.6(2)(1)). <br />14. The Division has contacted the Office of Surface Mining, Reclamation <br />Fees Branch. As of this time, Pittsburg & Midway, the operator, is <br />current in the payment of reclamation fees required by 30 CFR Chapter <br />VII, subchapter R. (2.07.6(2)(0)). <br />15. The Division finds that the activities proposed by the applicant would <br />not affect the continued existence of endangered or threatened species <br />or result in the destruction or adverse modification of their critical <br />habitats (2.07.6(2)(rU). <br />16. Specific approvals have been granted or are proposed. These approvals <br />are addressed in the following section, Section B (2.07.6(2)(m)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4 <br />Roads - Rule 4.03 <br />Haul Roads <br />The applicant has made a demonstration, based on site <br />specific precipitation rates, percent of grade, and soil <br />properties, that use of alternative specifications for <br />culvert and bridge sizing will not result in increased <br />erosion. Along selected segments of the haul road in the <br />Moffat Area, the spacing of culverts was not in compliance <br />with Rule 4.03.1(4)(e)(vi>.
