• -3- • <br />Surface coal mining and reclamation operations to be conducted in Sections <br />5 and 6 of TSN, R90W;_ Sections 29, 30, 31, and 32 of T6N, R90W; Sections <br />25, 36, and the E# of Sections 26 and 35 of T6N, R91W; and Section 1 and the <br />E'^i of Section 2 of TSN, R91W include: <br />Z. Vegetation sampling and monitoring <br />2. Fish and wildlife sampling, monitoring, and mitigation <br />3. Ground, surface, and alluvial water sampling and monitoring <br />4. Air sampling and monitoring <br />5. Maintenance of perim2ter markers, signs, and boundaries <br />6, Activities related to security and safety of the operation <br />7. Development drilling <br />8. Ybpsoil sampling <br />9. Cultural and historic resource surveying <br />The permit application and the stipulations will become a binding part of <br />the permit upon approval. The stipulations for the Trapper Mine are as <br />follows: <br />1. WITHIN SIX MONTHS OF PERMIT ISSUANCE, THE PERMITTEE AND THE DIVISION <br />WILL DEVISE ACCEPTABLE CRITERIA F1~R THE EVALUATION OF REVEGETATION <br />SUCCESS FOR HERBACEOUS COVER AND PRODUCTIVITY, TO BE APPLIED TO ALL <br />AREAS RECLAIMED DURING THIS PERMIT TERM. <br />2. THE DIVISION DIRECTS THE PERMITTEE TO MONITOR POST-MINING TOPOGRAPHY OF <br />BRCKFILLED AND REGRADED SURFACES OF THE DISTURBED AREA AT THE TRAPPER <br />MINE. MONITORING FOR THIS PURPOSE SHALL CONSIST OF A CONTOUR ~MRP <br />(CONTOUR INTERVAL NOT TO EXCEED 5 FEET) PRODUCED FROM AN ANNUAL SURVEY <br />UTILIZING FIELD OR AEROPHOTOGRAMMETRIC I1'ECXNIQUES ACCEPTABLE TD THE <br />DIVISION. THE POST-MINING TOPOGRAPHIC MAPS SHALL BE SUBMITTED TO THE <br />DIVISION FOR REVIEW AND APPROVAL ON RN ANNUAL BASIS, COMMENCING IN <br />JANUARY, 1984. <br />3. TXE DIVISION DIRECTS THE PERMITTEE, IN CONSULTATION WITH THE DIVISION, TO <br />PREPARE AND SUBMIT FOR APPROVAL A PLAN FOR VERIFICATION OF THE 25$ <br />OVERBURDEN SWELL FACTOR PROJECTED BY THE PERMITTEE FOR TXE TRAPPER MINE. <br />THIS PLAN SHALL BE SUBMITTED IN ACCEPTABLE FORM WITHIN 6 MONTHS FOLLOWING <br />PERMIT APPROVAL. THIS PLAN SHALL INCLUDE A SCHEDULE FOR COMMENCEMENT <br />RND COMPLETION OF THE VERIFICATION AS EXPEDITIOUSLY RS POSSIBLE. FURTHER, <br />SHOULD THIS VERIFICATION DISCERN AN INACCURACY WHICH, IN THE OPINION OF <br />THE DIVISION, AFFECTS THE ABILITY OF THE OPERATOR TO ACHIEVE THE PROJECTED <br />POST-MINING TOPOGRAPHIC CONFIGURATION, THEN THE OPERATOR SHALL REVISE THE <br />MINING AND RECLAMATION PLAN APPROPRIATELY. IN THE CASE THAT A REVISION <br />OF THE PLAN IS NECESSITATED, THE REVISION SHALL BE SUBMITTED TO THE DIVISION <br />FOR REVIEW AND APPROVAL WITHIN 6 MONTHS FOLLOWING ISSUANCE OF THE DIVISION''`S <br />OPINION REQUIRING AMENDMENT OF THE PLAN, <br />An explanation of each stipulation can be found in the following secfidns of <br />the Findings portion of this package: <br />XII. Vegetation <br />XVII. Backfilling and Grading <br />The permit cannot be issued until all statutory notice and public comment <br />requirements have been satisfied, and until bond has been posted. <br />
