-z- PROPOSED DECISION The Colorado Mined Land Reclamation Division proposes to approve, with stipulations, an application for a permit to conduct coal mining submitted_ by Trapper Mining, Inc. (a wholly owned subsidiary of Utah International, Inc.) for the Trapper Coal Mine. The proposed approval applies to the area described on Map 4 which lies within Sections 1, 2, 3, 4, and 5 of TSN, R91W; Sections 5 and 6 of TSN, R90W; Sections 29, 30, 31, and 32 of T6N, R90W; and Sections 25 through 29, and 32 through 36 of T6N, R9IW. The Division has made the required findings for approval of all surface coal mining and reclamation operations as identified and described in the permit application, subject to the stipulations and conditions stated in the findings document and this proposed decision. This approval is based on a finding that the proposed operation as identified and described in the permit application for this five-year term will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, C.R.S. 1973, as amended, 34-33-101 et seg., and the Regulations promulgated pursuant to the Act. The permit application for the Trapper Mine contains a complete mining and reclamation plan for the area to be disturbed by the extraction of coal during the five-year permit term. A complete mining and reclamation plan for the area to be disturbed by the extraction of coal during succeeding -~ permit terms has not been submitted~and,has not ,been reviewed or approved by the Division. Prior to conducting any surface coal mining and reclamation not specifically identified in this permit application for this five-year term, the permittee must submit the appropriate informatuon to the Division and receive written approval in accordance with Section 34-33-115 or Section 34-33-116 of the Act. After the termination of this permit term or at the time the permittee applies for permit renewal, the permittee must submit a permit application in accordance with Section 34-33-110 and receive written approval from the Division or the Board in accordance with Section 34-33-114 prior to conducting any surface coal mining and reclamation operations not specifically approved during this term and therefore, not subject to the provisions of Section 34-33-109(7).of the Act.
