• -10- • <br />I. Le4a1, Fi <br />2.07.6(g) and 2.07.6 <br />2.07.6 <br />The Legal, financial, and compliance information has been reviewed by the Division <br />for compliance. This information is contained in the permit application under <br />Sections 1.0 - 1.3 (pages 1-1 - 1-30) and 1.5 - 1.7 (pages 1-60 - 1-66) and Appendix <br />B. The proposed operation has been found to be in compliance. <br />The 10,355 acre area designated in the permit application as the permit area is <br />considered by the Division to represent the majority of the life-of-mine area. <br />The Division is approving all surface coal mining and reclamat_ion_activities specifically <br />described within this permit application for this five-year term, including those <br />activities listed on page 3, within Sections 2,3,4, and 5 of TSN, R91W; dnd Sections 25 _ <br />through 29 and 32 through 35 of T6N, R91W. Specific activities are outlined on page 3 of <br />this document are approved for Sections 25,26,35, and 36 of T6N, R91W; Sections <br />1 and 2 of TSN, R91W; Sections 29 through 32 of T6N, R90W; and Sections 5 and 6 of <br />TSN, R90W. <br />The applicant has provided documentation pursuant to 2.07.6(2)(f) that in all cases <br />where the private mineral estate has been severed from the private surface estate, <br />the applicant has secured the right to the extraction of coal by surface mining <br />methods, by means of lease agreements between the applicant and the surface owner. <br />The applicant has provided a description of each lease and its conditions. Actual <br />legal documents are on file at the Moffat County Courthouse in Craig, Colorado. <br />Pursuant to 2.07.6(2)(g), the Division makes the finding that no surface coal mining <br />operation owned or controlled by the applicant is currently in violation of any <br />statutes or rules or regulations as delineated in 2.07.6(1)(b). <br />The Division makes the finding, pursuant to 2.07.6(2)(h), that the applicant does not <br />control and has not controlled mining operations with a demonstrated willful pattern <br />of violation which would indicate an intent not to comply with provisions of the <br />Colorado Surface Coal Mining Reclamation Act. <br />ll. Land Use (Rules 2.04.3, 2.05.5 and 9.16) <br />Information on historic and pre-mining land uses may be found in Section 2.5 (pages <br />2-170 - 2-180), and Appendix F of the application. Information pertinent to post- <br />mining land use may be found in Sections 4.2 (pages 4-4 - 4-12), 4.3.5 (pages <br />4-98 - 4-100), and Appendix O. <br />Lands within the proposed permit area have exhibited three major historic land uses; <br />rangeland (grazing of sheep and cattle), cropland (cultivation of dryland crops, <br />predominantly wheat), and wildlife habitat. Rangeland and wildlife habitat comprise <br />approximately 24~ and GO o, respectively, of the proposed permit area and are located <br />on slopes and toe-slopes along the north face of the Williams Fork mountains. Crop- <br />land is found predominantly on the flatter areas north of the toe-slopes and in <br />areas surrounding the north-draining gulches of the area, and comprises approximately <br />l6~ of the proposed permit area. <br />The applicant proposes to reclaim the disturbed area to a post-mining land use of <br />rangeland, wildlife habitat, and cropland. This does not constitute a change in Land <br />use. Pursuant to 2.07.6(2)(1) and based on the successful reclamation accomplished <br />to date, the Division approves the post-mining land use of rangeland, wildlife <br />habitat, and cropland. <br />The operation is in compliance with the requirements of this section. <br />f <br />
