VIOLATIONS 050265, 050320, AND 052522 KENTUCKY PERMIT 8980140. PROOF OF <br />RESOLUTION AND SETTLEMENTS SHOULD BE SUBMITTED TO THE COLORADO <br />DIVISION OF MINERALS AND GEOLOGY AS SOON AS THEY BECOME AVAILABLE. <br />Based on the AVS recommendations as a result of this permit renewal, the Division considers <br />this stipulation resolved and it was terminated as a result of this permit renewal. <br />Two stipulations were issued as a result of this Permit Renewal No. 1 (RN-O1). Due to the <br />uncertain future of further coal mining operations at this site, these stipulations are necessary to <br />ensure that any future coal operations and disturbances are approved and bonded prior to <br />additional disturbance at the site. <br />Simulation No. 20 <br />THE PERMIT RENEWAL NO. 1 (RN-O1) IS APPROVED AS A RECLAMATION ONLY <br />PERMIT. IN THE EVENT THAT THE LORENCITO CANYON OPERATION IS PLANNED <br />TO REOPEN FOR COAL MINING AND REMOVAL, THE OPERATOR SHALL SUBMIT A <br />PERMIT REVISION, RECEIVE APPROVAL FOR, AND SUBMIT ANY INCREASE IN <br />RECLAMATION BOND, PRIOR TO ANY ADDITIONAL DISTURBANCE OF LANDS <br />WITHIN THE PERMIT AREA. <br />Technical Revision No. 8 (TR-08) was approved in July 2002 and approved an increase in the <br />size of Fi115 and Fill 8 along with construction of a new pond 8A. Due to the unforeseen <br />cessation of mining activities, activities approved under TR-08 were not implemented. TR-08 <br />increased the reclamation bond liability by $465,999.00, from $2,387,682.00 to $2,853,681.00. <br />As of this time, the operator has not submitted bond to cover these approved activities. Although <br />the operator has stated their intention to not implement TR-08, the Division has issued the <br />following stipulation. <br />Stipulation No. 21 <br />LORENCITO COAL COMPANY SHALL NOT IMPLEMENT ACTIVITIES APPROVED <br />UNDER TECHNICAL REVISION NO. 8 UNTIL THE REQUIRED BOND IS SUBMITTED <br />AND ACCEPTED BY THE DNISION. THE REQUIRED LIABILITY FOR THE ENTIRE <br />MINE AS A RESULT OF TECHNICAL REVISION NO. 8 IS $2,853,681.00. <br />Summary <br />The Review Process <br />Lorencito Coal Company, LLC, submitted an application for permit renewal (RN-Ol) to the <br />Division on May 2, 2002. The renewal application was reviewed by the Division and found <br />complete. Notification of the filing of a complete application was forwarded to the applicant on <br />May 18, 2002. This notification was also sent to the appropriate governmental agencies, <br />including the Division of Wildlife, Las Animas County Planning Office, Las Animas County <br />
