Pr~osed Decision <br />The Colorado Division of Minerals and Geology approves an application for a permit renewal <br />(RN-O1) of a five-yeaz permit to conduct surface coal mining reclamation operations only. At the <br />time the permit renewal application was submitted and found complete by the Division, the <br />operation was actively removing coal for shipment. Shortly after that, in June 2002, the mine <br />shut down operations due to market conditions. Some months subsequent to the shutdown, the <br />mine began backfilling and grading the disturbed area and eliminating highwall areas. At this <br />time, the mine has backfilled and graded all areas. In a letter dated November 4, 2003, the <br />applicant has stated that they will not be implementing activities under Technical Revision No. 8 <br />(TR-08) and have requested that the permit be renewed for reclamation operations only. No <br />detailed mine plan is proposed or approved at this time. Mine plan information remains in the <br />permit application for historical purposes and serves as a description of the operations during the <br />short life of the coal mining and removal. Stipulations No. 20 and No. 21 have been issued with <br />this Permit Renewal No.l (RN-O1). In the event the operation is sold, a new owner would be <br />required to submit and receive approval of a permit revision that details a mine plan for the <br />operation, submit a new reclamation cost estimate, and submit and receive Division acceptance <br />of a reclamation bond prior to any additional disturbance. <br />Life of mine information indicates both surface and underground coal reserves in the permit area, <br />as shown on Man 2.05.3- 1, Mine Plan. Haul roads constructed to-date include the Lorencito <br />Canyon Haul Road and the Jeff Canyon Haul Road. The Jeff Canyon haul road was previously <br />approved via Technical Revision No. 6 (TR-06). A raw coal loadout is approved and is <br />currently located at the mouth of Lorencito Canyon. The rail line has been removed from the <br />valley by the owner A & K railroad. Any future coal operation would truck coal to market via <br />Highway 12 that runs up the Purgatoire River Valley. <br />This decision is based on a finding that operations conducted by Lorencito Coal Company will <br />comply with all requirements of the Colorado State Program as found in the Colorado Surface <br />Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated <br />pursuant to the Act. If no request for a formal hearing is made within thirty (30) days of the first <br />publication of the issuance of this proposed decision, then this decision becomes final. The <br />permit application, all supporting documentation, and any stipulations or conditions will become <br />a binding part of the permit. <br />Stipulations <br />One stipulation was active during review of permit renewal no. 1 (RN-O1).
