E. The Division approves of the reference areas that the applicant has selected based <br />on the requirements of Rule 4.15.7(3). Extended reference areas will be used. <br />Reduction in size of the permit azea from 17,000 acres to 3142 acres as a result of <br />PR-O1 will not affect the ability of the applicant to utilize the extended reference <br />area concept. The areas are depicted on Map 2.04.10-1 Vegetation Community <br />Map. <br />F. The reference aeeas will be utilized to determine revegetation success in a manner <br />that the Division finds acceptable (4.15.7(4)). <br />XII. Post-mining Land Use <br />No specific approvals are granted under this section. <br />XIIL Protection of Fish, Wildlife and Related Environmental Values <br />A. Fish and wildlife habitat is secondary use of the reclaimed area. The applicant has <br />a plan for the re-establishment of shrubs on portions of the reclaimed areas of the <br />surface mine. (4.18(5)(I)) <br />XIV. Protection of Underground Mining <br />A. The Division does not approve surface coal mining activities being conducted <br />within 500 feet of an active or abandoned underground mine. (4.19(1) and <br />4.22.4(1)) <br />XV. Subsidence Control <br />No specific approvals are granted under this section. <br />XVI. Concurrent Surface and Underground Mining <br />No specific approvals have been granted under this section (4.22.2). <br />XVII. Operations on Alluvial Valley Floors <br />A. The Division has determined that an alluvial valley floor exists within the affected <br />or adjacent area. Therefore, the following findings are in order for the portion of <br />the alluvial valley floor known as Purgatoire River AVF located at the mouth of <br />Lorencito Canyon and flood irrigated by the Chacon ditch. <br />The Division finds that activities proposed by the applicant will not interrupt, <br />discontinue, or preclude farming on the alluvial valley floors that are irrigated or <br />naturally subirrigated.
