.. <br />-4- <br />• The reclamation costs _f or Phase II of the reclamation plan are based on the <br />worst-case backfilling, topsoiling, and revegetation during this period of <br />mining 1n the active mining area. Mithin the mining area the Eastside and <br />Westside pits were open, Phase I of mining was partially backf111ed, and Phase <br />I needed to be topsoiled and seeded. Volumetrics were calculated based on two <br />recent surveys of the open pits; Westside pit - volume as stated in the <br />October 18, 1982 option agreements ~~ <br />t Eastside pit - survey by American West Mineral Consultants Inc., <br />August 15, 1983. The survey of the Eastside pit was used to construct twelve <br />cross-sections through the 2,000 foot long pit. The volume of the pit was <br />evaluated by using an average side area estimation technique. <br />An Informal public hearing was held on September 29, 1983 at G.E.C.'s <br />request, The Division granted temporary relief from CO 83-001 to allow <br />G.E.C. Minerals to proceed with surface coal mining and reclamation operations <br />which would reduce the reclamation liability of G.E.C. Strip. G.E.C. then <br />requested formal review of the CO before the Board. On November 17, 1983 the <br />Mined Land Reclamation Board conducted a hearing to consider G.E.C.'s request <br />for temporary relief from CO 83-001. The Board granted G.E.C.'s request to <br />extend the time for abatement of CO 83-001 to 90 days, December 27, 1983. <br />G.E.C. did not meet the December 27, 1983 deadline for abatement of CO 83-001 <br />nor have then since submitted the performance bond required by CO 83-001. At <br />this time the on-site disturbance is underbonded by at Teast 5212,000.00. <br />Notices of Violation 84-005. 84-006. 84-007, 84-008. and 84-010 <br />Notices of Violation 84-005, 84-006, 84-007, 84-008, and 84-010 are Issued to <br />G.E.C. Minerals, Inc. on February 16, 1984. NOV 84-005 was issued for failure <br />to maintain sediment control structures. NOV 83-006 was issued for (allure to <br />adequately store topsoil. NOV 84-007 was issued for (allure to repair gullies <br />in the reclaimed area. NOV 84-008 was Issued for failure to adequately secure <br />the site so as to protect the health and safety of the public. NOV 84-010 was <br />issued for failure to submit responses to Stipulations 1, 2, 3, and 10 as <br />required by permit C-037-81. <br />Show Cause Order <br />On January, 20, 1984, the Division found that a "pattern of violation" as <br />described Dy Rule 5.03.3(2) existed at the G.E.C. Strip Mine. Specifically, <br />G.E.C. has been found in violation of the approved reclamation plan for permit <br />C-037-81 1n two enforcement actions dating back to June 27, 1983 and had <br />consistently failed over a period of eight months to adequately rectify the <br />problem as required by the Act. Therefore, a Show Cause Order was Issued to <br />G.E.C. Minerals, Inc. to demonstrate why permit C-037-81 should not be <br />suspended or revoked. Since the issuance of this order the Division has found <br />the site to be abandoned and issued flue other violations in an effort to <br />bring the mine into compliance. To date, the Division has not received any <br />response from G.E,C. Minerals, Inc. concerning the Show Cause Order or these <br />additional violations to enter into the record. <br />
