<br />-2- <br />The permit area of 6.E.C. is located within Township 20 South, Ranges 69 and <br />70 West of the 6th Principal Meridian. The primary areas of disturbance are <br />delineated on this index map labeled as Exhibit 26. I have also prepared <br />these aerial photos to supplement the index map. These aerial photos were <br />taken on May 5, 1983 and are labeled as Exhibits 27 and 28. Briefly, the <br />active mining areas shown on the Index Map are colored red. They are the <br />Tipple, Stockpile No. 1, and Areas I and II. The areas colored in blue are <br />inactive sites for which G.E.C. has a continuing obligation to reclaim. They <br />are the Refuse, North Orphan, Orphan, and Prospecting Pit. I will refer to <br />this map throughout my presentation. <br />Turning now to the substance of my testimony, I would like to review a brief <br />chronology of the enforcement activities that the Division has undertaken at <br />G.E.C. over the last nine months. <br />Notice of Violation 83-21 <br />The first action for this period was Notice of Violation 83-21. NOV 83-21 was <br />issued to G.E.C. Minerals, Inc. on June 21, 1983 for failure to follow the <br />reclamation plan approved as Exhibit 21 of permit C-037-81. A Proposed Civil <br />Penalty was assessed for this NOV on July 15, 1984. An Assessment Conference <br />concerning NOV 83-21 was requested by G.E.C. Minerals, Inc. on July 20, 1983. <br />G.E.C. requested an extensl~~o~n~~~,of time to abate NOV 83-21 on July 22, 1983. An <br />extension was granted on A~jir~t 25, 1983. An Assessment Conference was held <br />on August 22, 1983. A Proposed Settlement Agreement was sent to G.E.C. on <br />August 24, 1983. A final Settlement Agreement was executed on September 1, <br />1983 by G.E.C. Minerals, Inc. establishing a civil penalty of ;1,500.00 for <br />NOV 83-21. G.E.C. did not pay this civil penalty within 30 days as required <br />by the terms of the Settlement Agreement nor have they, to date, paid the <br />civil penalty associated with NOV 83-21. <br />Cessation Order 83-001 <br />The next enforcement action was the issuance of Cessation Order 83-001 to <br />G.E.C. Minerals, Inc. for failure to follow the approved reclamation plan and <br />failure to have adequate performance bond for the G.E.C. Strip Mine. G.E.C. <br />was ordered to abate CO 83-001 by continuing reclamation activities and <br />submitting an additional bond of ;212,000.00. <br />~~ <br />~f RY~-°~ <br />~~ <br />The Divistbn calculated G.E.C. Minerals, Inc. to be underbonded by ;212,000.00 <br />based upon the following calculations. <br />~~ <br />
