• 2 The following terms and conditions are NOT suspended. 1. Royalty payments for coal mined prior to the effective date of this suspension but sold or otherwise disposed of during the suspension period; 2. Royalty payments for coal mined for safety purposes during the suspension period; 3. Reclamation requirements; 4. Mine maintenance requirements; 5. Casual use as defined at 43 CFR 3400,0-5(e); 6. Public and mine personnel health and safety requirements; and 7. Diligent development commercial quantities requirement of sec. 7 of the MLA. The following are terms and conditions of the suspension. 1. The State Director, Colorado, shall be notified immediately upon the cessation of the condition, situation, or event which constituted the basis for the suspension. 2. The State Director, Colorado, shall be notified by the lessee Smmediately upon recommencement of beneficial use of the lease. 3. The lessee shall certify to the State Director, Colorado, prior to the end of each successive 12-month period following the effective date of the suepeneion, that the conditions justifying the suspension continue. 4. The lessee shall submit a permit revision application to Colorado Mined Land Reclamation Division and a resource recovery and protection plan amendment to BLM that reflects any changes in the mining and reclamation plan caused by the suspension. 5. This suspension may be extended until such time as the access provided by C-078049 is no longer required to recover reserves on adjacent federal leases. Eateneion will be considered if application is made before expiration of the four-year term. 6. This suepeneion shall terminate upon: a. The date beneficial use of the lease recommences; or b. The date the situation determined to be in the interest of conservation ceases; or c. The date that annual recertification of continuing conditions ie due but has not been filed by the lessee; or d. The expiration of the approved suspension period, whichever occurs first.
