Harvard Ave. <br />Suite 400 <br />Denver, Colorado 80231 <br />~ i tsse <br />III IIIlilllllllllll <br />999 <br />~~ <br />~ ^ <br />CO-923 <br />3483 <br />C-078049 <br />Coal <br />Lease Suspension Granted <br />On August 20, 1987, Povderhorn Properties Company applied for a suspension of <br />operations and production on coal lease C-078049 pursuant to section 39 of the <br />Mineral Leasing Act of 1920 (HI.A), as amended, and the implementing <br />regulations at 43 CFR 3483.3. <br />Povderhorn has developed federal coal lease C-078049 according to the approved <br />Resource Recovery and Protection Plan for the Roadside Hine. Less than 30,000 <br />tons of recoverable coal remain on the lease, primarily in pillars which <br />support ventilation and access entries to mine workings on adjacent federal <br />leases. <br />In order to preserve access to the adjacent federal leases and in the interest <br />of conservation of the resource on the lease, the lease suspension requested <br />is hereby granted for a period of four years effective September 1, 1987, <br />subject to annual recertifica[ion as required by Stipulation 3 of this <br />decision. <br />This suspension of terms and conditions suspends the following requirements <br />during the effective term of the suspension. <br />1. Payment of rentals effective September 1, 1987; <br />2. Beneficial use of the lease effective September 1, 1987; <br />3. Commercial quantities production required by section 2(a)2(A) of the MLA; <br />4. Continued operation required by section 7(b) of the MLA; and <br />5. Payment of advance royalty in lieu of continued operation. <br />
