<br />We would like the protective fence shown in Vol. 1, p.2.05-36, C8-1122R removed. <br />It is not clear in the mine plan that it will be removed. <br />In addition, the mine plan states in Vol. 1, p.2.05-37 that the powerline road and <br />powerline reclamation will begin in 1996. Somerset Mining Company has a BLM right- <br />of-way (COC41183) for this line and road. This R/W is soon to be assigned to Oxbow <br />Carbon and Minerals, Inc. (Oxbow). We do not have a problem with not reclaiming <br />the road and powerline in 1996 provided that the subject reclamation requirement <br />continues to be a contingent of the Mining and Reclamation Plan and that the poles <br />and road be removed at some future date. <br />BLM has been working with Tom Anderson, Oxbow, in regards to acquiring <br />easements for public access across their private lands in both Bear and Hubbard <br />Creeks. Potentially, portions of the powerline access road may be acquired for this <br />purpose which could result in recommended variances to the Plan, i.e., that portions of <br />the road not be reclaimed. However, we are not in a position at this time to finalize <br />such agreements.
