The source of water specified in the above paragraph will <br />also be used for irrigation. 1f it is found that the specified <br />use cannot be used for irrigation, a request far change will be <br />initiated. <br />3. As explained in Exhibit "G", the water will be returned to the <br />ground water system through percolation and infiltration after <br />it has been in the sedimentation ponds fora sufficient amount <br />of time. <br />4. As stated in Exhibit "G", "No material injury to water rights <br />is anticipated by continued operation of the Empire Pit." There <br />is no history of any injury to water rights during the operation <br />of this pit over the last forty five years. <br />5. The owner is not aware of a state law which requires augmentation <br />for evaporative losses caused by surfaces cr°ated by mining <br />operations.
