• 2. The Division proposes to grant a small area exemption from use of sediment <br />ponds due to the limited size of the area and due to the fact that ponds and <br />treatment facilities are not necessary for ffie drainage to meet the effluent <br />limitations of Rule 4.05.2 and applicable State and Federal water quality <br />standards for receiving streams, and also due to the fact that no mixing of <br />surface drainage from underground workings will occur. The small area to <br />be exempted is located along the entrance road on the west side of the entry <br />bridge (4.05.2(3)). Technically, a small amz exemption is not needed for <br />this area since tire subject drainage is from a road. <br />B. Diversions and Conveyance of Overland Flow <br />Disturbed area drainage is controlled.and contained by numerous designed <br />containment ditches. Design details are located in the approved permit <br />application at Section 4.05.3. <br />C. Stream Channel Diversions <br />1. The Bear Coal Company does not propose permanent or temporary <br />diversion of stream channels. Some flood control work was previously <br />approved and performed along the North Fork of the Gunnison River. <br />Details are provided within the approved permit document at Section 4.05.4. <br />• D. Sedimentation Ponds <br />All site sediment ponds are designed and constructed in accordance with <br />Rule 4.05.6. Design details are contained within the approved permit <br />document at Section 4.05.6 and Exhibit 11. <br />E. Acid-forming and Toxic-forming Spoil <br />1. Acid-forming and/or toxic-forming materials have not been identified at the <br />Bear Coal Company Mine Nos. 1, 2, and 3. <br />F. Impoundments <br />1. All site impoundments are in compliance with Rule 4.05.9. Refer to <br />Section II, D, above. <br />G. Surface and Ground Water Monitoring <br />1. The applicant will conduct monitoring of ground water in a manner <br />approved by the Division (4.05.13(1)). Details can be found in <br />• Section 4.05.13 of the permit application. <br />2.
