• facilities with Colorado State Highway 133 at Somerset, Colorado. The road is <br />approximately 0.25 miles long and passes over a bridge which crosses the North <br />Fork of the Gunnison River. The road design was approved by the Division and <br />has been certified as being constructed as designed. A technical revision to <br />widen the road has been approved and the mad is certified as being widened as <br />designed. Sediment control for the access mad is accomplished by a berm on <br />the outside of the road which directs ronoff through straw bales adjacent to the <br />mad. <br />Bear Coal Company has widened and modified the original access mad to the <br />abandoned Edwards portals to access the Bear No. 3 portals. Bear Coal has <br />conducted stability studies to assess the stability of the Bear No. 3 portal access <br />mad. Bear Coal conducts semi-annual stability monitoring of the access road to <br />access the stability of the mad. <br />The portal access road meets the permanent program criteria with the approved <br />monitoring pl:m. <br />The operation is in compliance with this section. <br />II. Support Facilities -Rule 4.04 <br />• A. Information regarding the mine facilities of the Bear No. 3 Mine are contained <br />in Sections 2.05.2 and 2.05.3, Map 10, of the Bear No. 3 permit revision <br />application and in 1?xhibits 14, 19, and 24 of the Bear midterm responses. <br />Surface support facilities at the Bear No. 3 Mine include an office, two <br />warehouses, power substation, fuel transfer and storage area, conveyors, <br />stacking tube and a truck loadout. A sedimentation pond collects mnoff from <br />the site to mitigate any adverse mining impacts to surface waters. Effluent from <br />the pond must meet NPDES permit standards. <br />All surface facilities of the Bear No. 3 Mine, except the office building, are to <br />be removed upon cessation of mining activities. Anchor Coal Company has <br />requested that the building be retained as part of the post-mining land use. <br />The Bear Coal operation is in compliance with tire provisions of this section. <br />III. Hydrologic Balance -Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />1. The applicant has demonstrated that sediment ponds and/or treatment <br />facilities will function properly to ensure that disturbed-area drainage will <br />• meet the effluent limitations of 4.05.2 and the applicable State and Federal <br />water quality requirements for downstream receiving waters. <br />17 <br />
