<br />Mr. Tom Wainwright <br />Page -2- <br />4B rnnt~d <br />Seneca Coals Ltd, shall submit these reports by December 31 of each year, <br />9. Seneca Coals Ltd. submitted a reclamation plan for the mine-related distur- <br />bance on the Grassy Creek alluvium on November 23, 1981. Further research by <br />mine personnel of, 1966 aerial photographs, U.S.G.S. topographic maps, old mine <br />map and discussion with employees employed before construction began revealed <br />that the office/shop area is not located on alluvium. The office/shop area was <br />a level knob above the alluvium. Vegetation communities surrounding the shop <br />represent upland communities. Based on this information Seneca Coals, Ltd. is <br />proposing to reclaim the area to grazing land consistent with other poXtions <br />of the permit area, as discussed in Tab 13 of the permit application. The <br />Division reviewed the listed documentation provided by Seneca Coals, Ltd. and <br />approves the revegetation portion of the reclamation plan. <br />Included in the reclamation plan is a proposal to modify the N.W. pond, /1003 <br />to a permanent stoclcwater pond. Before the Division can approve this the <br />requirements of Rule 4.05.9(1), permanent impoundments, must be addressed. <br />Also, page 7-136 states that all sediment ponds will be removed. The statement <br />should be modified. <br />10. A written finding on the Fish Creek alluvial valley floor Boas issued <br />November 16, 1981. <br />12. To answer and resolve Stipulation 12, Peabody is planning to research, <br />this summer, the establishment of shrubs on 3 reclaimed areas: 1) regraded <br />spoil, 2) regraded spoils with topsoil form stockpiles and 3) regarded spoils <br />with direct topsoil replacement. A shrub density standard will be established <br />by November 1, 1982 based on the data provided by this study and any other <br />research from the area. <br />14. An adequate response for the use and control of acidic material in embank- <br />ment construction was provided for Stipulation 14, and is found on page 12-22 <br />of the permit application. <br />15. An adequate response addressing erosion control measures where drainage <br />ditches discharge onto open terrain was incorporated into the permit appli- <br />cation on page 12-23. <br />16. The up and downstream embankment slopes were revegetated during the fall of <br />1981. The seeding success will be checked this summer. <br />17. In response to this stipulation, Seneca has staked the 6941.1 foot <br />elevation upstream from the 100 foot embankment. This is the projected backwater <br />elevation for a 10-year 24-hour maximum storm event. Should the backwater <br />reach this elevation, the embankment must be inspected and a letter of certification <br />shall be submitted to the Division. <br />
