Lamm <br />Governor <br />March 31, 1982 <br />PSr. Tom Wainwright <br />Seneca Coals, Ltd, <br />Campus 6 Office, Suite 600 <br />12015 E. 46th Avenue <br />Denver, Colorado 80239 <br />RE: Status of Permit C-005-81 Stipulations <br />Dear Mr. Wainwright: <br />The Division has received and is reviewing Seneca Coals, Ltd. responses to <br />the stipulations attached to Ptined Land Reclamation permit C-005-81, All <br />stipulations requiring responses have been submitted within the required <br />time frame. The following discussion provides a status report of the <br />stipulations and their fulfillment of the regulations. <br />Stipulations 2, 3, 11 and 16 require no written response. Stipulation 13 <br />requires an annual submittal and Stipulation 17 requires either an annual <br />submittal or an engineerb report within 10 days following a storm whose <br />backwater exceeds the 6941.1 foot level which has been surveyed on site. <br />The Division is in the process of reviewing Stipulations 5 and 6. Below <br />is the status of each remaining stipulation. <br />1. The landoemer's had the opportunity to read the reclamation plan <br />and have signed a form approving the post-mining land use. The information <br />provided by Seneca Coals Ltd. fulfills the requirements of Rule 2.05.5(1)(b). <br />2. An adequate archaeological statement was incorporated into Appendix <br />5-2 of the permit application. <br />4. The maps showing the Lennox seam outcrop line, cover over the Lennox <br />seam and the Lennox seam thickness have been adequately revised. <br />7. The lysimeterstudy has not been published yet, Partial results were <br />submitted. Once the study is completed and published Seneca Coals, Ltd. <br />has committed to sending the Division a copy. <br />8. As stated in Seneca's November 24, 1981 response, representatives of <br />Seneca and the Division met bn November 4, 1981 to discuss the pollutant <br />G <br />C plume model. Because of problems encountered with the model, an alternative program <br />established to monitor the movement of total dissolved solids from the <br />spoils to the alluvium, Seneca's response accurately reflects the monitoring <br />program except for the report requirements. It was decided that a short annual <br />report discussing the results of the data, referencing previous data and <br />the effects the data may have on the hydrologic balance would be submitted. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
