<br /> <br />THE PERMITTEE SHALL PROVIDE AN ASSESSMENT OF THE PROBABLE HYDROLOGIC <br />CONSEQUENCES OF SECONDARY OR RETREAT MINING ON THE QUANTITY AND QUALITY <br />OF SURFACE WATER IN CIRUELA, APACHE AND PETE CANYONS. <br />ALL MONITORING MUST CONTINUE UNTIL DISCONTINUATION IS APPROVED BY THE <br />DIVISION IN WRITING. <br />In order to verify the applicant's statement of probable hydrologic <br />consequences of mining, identify adverse effects to the system, and <br />ensure that the operations are conducted to minimize disturbances to the <br />prevailing hydrologic balance, the following stipulation was imposed upon <br />the permit. The operator has not committed specifically to continuing <br />with this annual hydrologic report therefore the stipulation is repeated <br />herein. <br />Stipulation No. 15 <br />THE PERMITTEE SHALL SUBMIT AN ANNUAL HYDROLOGIC MONITORING REPORT FOR THE <br />ALLEN MINE. THE MONITORING REPORT SHALL INCLUDE A SUMMARY AND ANALYSIS <br />OF DATA COLLECTED DURING THE YEAR, INCLUDING: 1) WATER USED IN THE <br />MINING OPERATION; 2) MINE WATER DISCHARGES TO RECEIVING STREAMS (QUANTITY <br />AND QUALITY); 3) MINE WATER INFLOWS (ANNUAL MINE INFLOW STUDY); 4) STREAM <br />FLOWS AND QUALITY; 5) IMPACTS TO THE QUALITY AND QUANTITY OF ALLUVIAL AND <br />BEDROCK AQUIFERS; AND 6) IMPACTS TO SPRING FLOWS AND QUALITY. THE <br />MONITORING REPORT SHOULD INCLUDE A DESCRIPTION OF MITIGATIVE MEASURES <br />TAKEN TO MINIMIZE DISTURBANCE TO THE PREVAILING HYDROLOGIC BALANCE. THE <br />MONITORING REPORT SHALL BE ADEQUATE TO PLAN FOR MODIFICATION OF SURFACE <br />OR UNDERGROUND MINING ACTIVITIES, IF NECESSARY, TO MINIMIZE DISTURBANCE <br />TO THE PREVAILING HYDROLOGIC BALANCE. <br />VIII. Alluvial Valley Floors = Rules 2.06:8 and 4:24 <br />There are two (2) identified alluvial valley floors (AVF) in the <br />hydrologically adjacent area of the operation. These AVF's are located <br />in Stonewall Valley (Middle Fork of the Purgatoire) and Picketwire Valley <br />(mainstem of the Purgatoire). The original findings document detailed <br />the evidence for determination of these valleys as AVF's along with the <br />predicted impact by the New Elk Mine. The Permit Revision No. 1 Findings <br />Document detailed predicted impact by the permit revision operation. <br />Both these findings remain valid for this permit renewal for these two <br />(2) AVF's. <br />Stipulation No. 16 was imposed on the permit due to the fact that a plan <br />was required from the operator demonstrating how the essential hydrologic <br />functions of the Stonewall Valley AVF under the then-active refuse area <br />would be preserved and restored. The operator's response to the <br />stipulation was submitted October 15, 1985 and contained revised <br />reclamation plans for this portion of the alluvial valley floor. The <br />plan has since been approved by the Division and Stipulation No. 16 is no <br />longer in effect. <br />In the original Findings document Apache Canyon was determined to be an <br />aliuviai valley floor based on a Tack of site specific information on <br />geology and subirrigation in the canyon. Stipulation No. 17 was imposed <br />on the permit and required further information on how the operation would <br />
